Hello Sunshine, Buncombe County will not be able to complete the request to supply copies of “Let’s Talk” requests/comments. There are almost 2,000 comments, questions, editorials, suggestions, grievances, and a variety of personal opinions and attacks. The information is not public record because it is restricted as confidential personnel-related information and also involves information impacting peripheral third parties. Therefore, the scope of the request is overly broad and unduly burdensome.

Also, of note, is the timing of the request you forwarded through Sunshine Request. At that time, there were certain internal concerns regarding personnel and duties within Buncombe County Government. Let’s Talk comments in the days immediately preceding our receipt of your information request were directly related to that Personnel matter. Rather than serving as a platform to make it easier for the public to make public records requests it appears that Sunshine Request was being used as a vehicle to publicize anonymous attacks against a coworker. Personal comments and opinions are not a matter of public record in accordance with GS §153A-98.

There are 800 hits in the Let’s Talk portal for this request. It will take significant time to sort through all these requests submitted to Let’s Talk. Many are along the line of “there’s a pot hole on my street, what do I do to have it fixed” or “how do I get a copy of my criminal record.” Would the requestor care to narrow this request down? That would improve turn-around time.
