(April 2023) Request for City of Asheville, NC Government: All emails, texts, and related documents 12/01/2021 – 02/28/2022 regarding 01/14/2022 meeting with Asheville Area Chamber of Commerce Staff, Asheville City Council Members, and Asheville City Staff.

Hello City of Asheville, NC Government (Records Officer),

I'd like to make a public records request for the following information under NC Public Records Law.

This request is related to communication records and documentation regarding an 01/14/2022 meeting.

Please provide ALL emails, attachments, text messages and related documents, concerning a meeting that occurred on January 14th, 2022 around 1:00 p.m. Previously released public records have indicated that this meeting was attended by Asheville Area Chamber of Commerce Staff, and local government officials (including - but not limited to - Mayor Esther Manheimer and Council Member Antanette Mosley).

Since additional members of City Council or City Staff may have also attended, I respectfully request that the search include the emails and text documents for each Member of City Council and any City Staff who also attended that meeting.

To clarify – I am requesting all communication records and documents pertaining to this meeting that were created by or in the possession of any member of City Council or any member of City Staff. During the specific time period of 12/01/2021 through 02/28/2022.

** Please note: I am not requesting to come in person to inspect, nor to obtain printed copies of, these electronic records. In accordance with NC Public Records Law, I’m requesting explicitly that all responsive records be provided via an electronic medium / format (in which the records should already exist), such as an email, file share, google drive folder, mailed flash drive if necessary, etc.

I do not have any additional or further clarifying info to provide other than what you see in the message above. If you are unable to fulfill any or all parts of this request, please specifically cite where a reason for its denial is justified under NC Public Records Law.**

    This is my last attempt to follow up regarding my public records request # 23-183 in the thread above. I first submitted it to the City on April 03, 2023.

     

    The last time I received a reply, was from Allison on November 28. I have followed up with you 4 times since then to ask for clarification, and have received no response.

     

    As I mentioned previously, until the City replies about the responsive records Allison says exist to satisfy my request, then I do not consider my request to have been Fulfilled by the City.

     

    Under NC Public Records Law, the City is required to “promptly” process all public records requests. I am concerned that you may be intentionally delaying or ignoring the fulfillment of requests by allowing them to “sit” until staff has availability, or feels like addressing my messages. With this in mind, I want to highlight the court case referenced in item #6 of the following article, posted on the NC Press Association website.     This is my 3rd and final attempt to follow up since my reply to Allison back on December 5, 2:25pm. I have not received any response.

     

    I understand Allison indicated that she conducted a complete search for any responsive records, and that she considers my request to be “Fulfilled”. However, I’d like to ask once again that she please provide me with the direct links (if the requests are public on NextRequest), or (if they’re not public) the requests’ numbers and their written content [Subject / Message], for each of the separate “requests / inquiries” that she’s saying allowed her to complete my request # 23-183 without creating any new communication records.

     

    Until I hear back from Allison about the responsive records that she says exist to satisfy my request, I do not consider my request to have been Fulfilled by the City.

    You previously collected documents for someone’s request #22-42 which only asked for “… all text messages exchanged between city council members, the mayor, and city staff from the month of January, 2022.”

     

    Our concern with your response to our request #23-183 to this point has been that we asked you for records spanning a wider time frame: “…created by or in the possession of any member of City Council or any member of City Staff. During the specific time period of 12/01/2021 through 02/28/2022”. Furthermore, our request asks for all emails, attachments, text messages, and related documents, concerning the meeting that occurred on January 14, 2022.

     

    This is clearly a much different request than #22-42.

     

    As a result, we do not feel that the documents you previously collected for #22-42 can represent an appropriate search for responsive records for the difference in time frames / communications that we’ve requested in #23-183.

     

    While we agree that #22-42 could provide some responsive “text messages” for January 2022, it would not produce responsive records created in December 2021 or February 2022 — nor would it include a search for emails, attachments, related documents, etc.

     

    It does not appear to us that you have performed the search we’ve requested. Can you please perform the search, as requested?

     

    If you’re refusing to conduct an appropriate query to find the responsive records for this request, then please specify where this is justified under NC Public Records Law.

    Hi Allison,

     

    Respectfully, I do not think that my previous messages have really been clearly addressed.

     

    On July 26, you indicated you’d performed a search of some kind and were “… unable to locate anything relating to a meeting on January 14, 2022”.

     

    I’m unsure how you made that determination. However, I was able to clarify that there were text messages exchanged about an 01/14/2022 meeting, and they’re public somewhere on the City’s NR portal.

     

    On July 31 you said that, “The only record responsive to this request is the text message conversation previously produced and already publicly available in the public records portal under request 22-42.”

     

    The “previously produced” request you’ve referenced is # 22-42. As you know, this request is not mine, and it was submitted to you back in January of 2022. That sender asked you for “… all text messages exchanged between city council members, the mayor, and city staff from the month of January, 2022.”

     

    Not only is that request not mine, but the content of what was being requested of you by that sender does not match my April 2023 request above, and it should not be considered responsive to my request. Please reread my original request.

     

    I submitted my request to you more than a year after that sender, and I would expect that you would provide me with all the records which are responsive to MY request – so that it is stated explicitly and made clear what specific documents or files you’re saying are responsive. Those records have been requested of you as the disclosing agency, and as such you should provide them to me here.

     

    With this in mind —

     

    Can you please clarify whether at any point since July 2023 to the present you performed a new search for responsive Texts I asked for that were “… created by or in the possession of any member of City Council or any member of City Staff. During the specific time period of 12/01/2021 through 02/28/2022” for each Member of City Council and any City Staff who also attended that 01/14/22 meeting? And that, you’re also saying that having performed that search, there are no responsive records for my request?

     

    Since we seem to disagree on whether you performed an appropriate search to determine whether there were additional records responsive to MY specific request … I’m asking again that you please provide me with the following:

     

    “Any texts or emails, where you (Allison or the City of AVL Public Records) asked for the relevant parties to provide their text messages, responsive to MY request.     1. I reviewed the referenced request # 22-42 on the City’s NR page (submitted in January of 2022). The sender asked for “… all text messages exchanged between city council members, the mayor, and city staff from the month of January, 2022.”

     

    The content of what was being requested by that sender does not match my April 2023 request above. As usual, please provide me with all the records which are responsive to MY request – so that it is stated explicitly and made clear what specific documents or files you’re saying are responsive to MY request. Those records have been requested of you as the disclosing agency, and as such you should provide them to me here.

     

    2A. Thank you for confirming there is a text conversation about a January 14, 2022 meeting. Now that this fact has been established, it also means there could be other texts that were exchanged about the meeting, and responsive to my request.

     

    With this in mind – I just want to check if you recently performed a new search for responsive Texts that were “… created by or in the possession of any member of City Council or any member of City Staff.     A text message conversation contained within a previously completed public records request — that you published on the City’s Next Request page — shows clearly that there were text messages exchanged between Council Members Mosley and Smith from January 06, 2022 through January 14, 2022 discussing coordination of a meeting with the Chamber for Friday, January 14, 2022 at either 1:00 or 1:30pm.

     

    And, Council Member Mosley and Smith discuss how one or both of them attended that meeting (whether it was remote or in person, is unclear) for at least some period of time that day. And that it was also attended by “Todd”, “the Chief” and “Vic”.

    Hello City of Asheville, NC Government (Records Officer),

     

    I’d like to make a public records request for information that may be available in your office.

     

    If you’re not the appropriate party to contact about the request, please provide the correct name and email address of whom I should send it to.

    Subject: (April 2023) Request for City of Asheville, NC Government: All emails, texts, and related documents 12/01/2021 – 02/28/2022 regarding 01/14/2022 meeting with Asheville Area Chamber of Commerce Staff, Asheville City Council Members, and Asheville City Staff.

     

    Message: “Hello City of Asheville, NC Government (Records Officer),

     

    I’d like to make a public records request for the following information under NC Public Records Law.

    Ref: https://www.ncleg.net/enactedlegislation/statutes/html/bychapter/chapter_132.html

     

    This request is related to communication records and documentation regarding an 01/14/2022 meeting.

     

    Please provide ALL emails, attachments, text messages and related documents, concerning a meeting that occurred on January 14th, 2022 around 1:00 p.m. Previously released public records have indicated that this meeting was attended by Asheville Area Chamber of Commerce Staff, and local government officials (including – but not limited to – Mayor Esther Manheimer and Council Member Antanette Mosley).

     

    Since additional members of City Council or City Staff may have also attended, I respectfully request that the search include the emails and text documents for each Member of City Council and any City Staff who also attended that meeting.

     

    To clarify – I am requesting all communication records and documents pertaining to this meeting that were created by or in the possession of any member of City Council or any member of City Staff. During the specific time period of 12/01/2021 through 02/28/2022.

     

    ** Please note: I am not requesting to come in person to inspect, nor to obtain printed copies of, these electronic records. In accordance with NC Public Records Law, I’m requesting explicitly that all responsive records be provided via an electronic medium / format (in which the records should already exist), such as an email, file share, google drive folder, mailed flash drive if necessary, etc.

     

    I do not have any additional or further clarifying info to provide other than what you see in the message above. If you are unable to fulfill any or all parts of this request, please specifically cite where a reason for its denial is justified under NC Public Records Law.**
