(August 2021) Request for information about Asheville, NC Police Department Officer exit interview reporting process 01/01/21 – 07/22/21

Hi City of Asheville, NC Government (Records Officer),

I’d like to make a multi-part public records request for the following information under NC Public Records Law:

A. Please provide all emails sent to and sent from, the City of Asheville Police Department's Chief Zack, Deputy Chief Baumstark, Deputy Chief Yelton, during the specific time period of January 01, 2021 through July 22, 2021.

Specifically, I am requesting all emails pertaining to the specific subject matter of exit interviews of APD officers.

B. Additionally -- Please provide a record (I am unsure of what the exact terminology is for this type of reporting mechanism... whether that's a "software", "tool", "program", or "spreadsheet" APD uses to enter these reports), which shows proof that Chief Zack or his Designee actually completed exit interviews with all officers who have left the department from 12/31/2020 through 08/11/201 (or as of the date the query is performed).

If no exit interviews were performed, please cite any explanations or justifications by the department as to why exit interviews were not performed.

For all requested items above, please provide all .pdfs, files, attachments, videos, hyperlinks, etc. that are indicated within the responsive records. For example: A .pdf that is an attachment within an email, should also be provided as a document along with the responsive emails.

If the records are ultimately too large to send via emailed file share, I'd ask that you please create a public Google Drive folder / link or some other file format to transfer the files electronically.

    Hello, Sunshine Request

     

    In regards to records request # 21-53, please see the following responses:

     

    A. There are no emails from the City of Asheville Police Department’s Chief Zack, Deputy Chief Baumstark, or Deputy Chief Yelton regarding exit interviews for the time period requested of January 1,2021 through July 22, 2021.

     

    B. The Asheville Police Department does not have a reporting mechanism (such as a software, tool, program or spreadsheet) in which reports of exit interviews are entered. The only proof of completion of exit interviews is recorded on the Asheville Police Departments Separation Checklist. Once completed, the checklist is stored in the employees file. Pursuant to North Carolina General Statute NCGS 160A-168 (Privacy of Employee Personnel Records) releasing those separation checklists that are placed in their personnel record would be a violation of that statute.
