Please reply promptly to the following public records request, which I’m making in accordance with NC Public Records Law. https://www.ncleg.net/enactedlegislation/statutes/html/bychapter/chapter_132.html
Please provide all quotes, bids, and invoices from March 15, 2024 through July 15, 2024 – specifically related to the HVAC repairs and replacement at Rock Springs Elementary School.
** I’m simply requesting an electronic copy of an electronic record, if one exists. I’m NOT asking for the opportunity to come in person to "inspect", nor to obtain a printed copy of, this electronic record. I’m requesting explicitly that any responsive info be provided to me via the electronic medium / electronic format (in which the copy of this record already exists). If you are unable to fulfill any or all parts of this request, please specifically cite where a reason for denial is justified under NC Public Records Law. **

Thank you for your reply.
I submitted the request on Aug. 07, and on Aug.14 you confirmed that you were “… working on gathering the information.” I am surprised to learn more than 1 month later, and having followed up twice, that you’re now attempting to assess a fee for what seems to be a fairly simple record to produce.
Public records are “considered to be the property of the people” and copies shall be provided for free or at a minimal cost. The types of documents I requested should be easily accessible to you, and certainly should not be eligible for a special service charge — as NC Records Law only allows you to charge fees for public records in very exceptional circumstances:
“… if the request is such as to require extensive use of information technology resources or extensive clerical or supervisory assistance by personnel of the agency involved, or if producing the record in the medium requested results in a greater use of information technology resources than that established by the agency for reproduction of the volume of information requested, … ”
https://www.ncleg.net/enactedlegislation/statutes/html/bysection/chapter_132/gs_132-6.2.htmlI do not feel that the documents I requested require an “extensive use” of IT resources or clerical / supervisory assistance. Since I’ve asked for electronic records, there should be no cost to produce this information.
Even amongst localities that do implement a special service charge, they all typically set the threshold at 4 hours or more — so it’s unclear to me why you’re asking for fees for the public records I’ve requested.
Please confirm whether you will proceed to process my request at no cost. If not, please provide the itemized explanations for each charge for this request, and please cite where those fees are justified under NC Records Law.
