  Thank you for reaching out. The password for the file is “sunshine” (case sensitive); this will also be the password for the PT data I will be sending you shortly in a separate email for security purposes.

   

  Also, please be aware that these documents represent the College’s full, not a partial, response to your records request. While you are correct that the information you are requesting is open to the public, community college personnel records are governed by NCGS Chapter 115D, Article 2A, not NCGS Chapter 132. While the public is entitled to copies of public records under Chapter 132, the language of Chapter 115D does not offer the same broad rights to the public.

   

  Under §115D-28(c), “every person having custody of the records shall permit them to be inspected and examined and copies made by any person during regular business hours.” This standard requires us to allow you to come to our place of business to inspect, examine, and/or copy records, not to provide the copies ourselves. Additionally, under §115D-28(a), the College is required to “maintain a record of each of its employees” with certain information; while the College maintains this information, it is on an individualized basis in each employee’s file, not in the aggregate.

   

  Given the above, the creation and provision of an Excel document that aggregates the requested information of individual employees in compliance with the restrictions of §115D-28 has been done as a courtesy to Sunshine Request and goes beyond statutory requirements. Unfortunately, due to the limitations of our systems and non-digital nature of some of our personnel information, we are unable to easily generate a report with hire dates for full-time personnel; similarly, not all data is available in the part-time personnel sheet for certain individuals. We regret any inconvenience this may cause, but we also ask that you consider your records request satisfied by the receipt of these two files given the College’s extensive efforts to provide them.

  I’d also like to clarify that my request called for the following:

   

  Please provide a list of all current “Full-time” and Part-time” CCCC employees / faculty / staff, and their salaries. As of the present day (on the date the query is performed). Please include the following:

   

  1) First / Last name
  2) Position / Title / Department
  3) Date of Hire
  4) Salary (including hourly wage, hourly rate, or salary — whichever payment structure is applicable to the employee)

   

  Marcie indicated today that no “… document exists for part-time employees because our systems do not support salary information for part-time employees.”

   

  All NC Universities and Colleges are public entities, and their basic salary info is considered a matter of public record as part of the public personnel file of employees. Many NC community colleges have fulfilled this same request for me before. The term “salary” is generally understood to include pay / benefits / incentives / bonuses / deferred and all other forms of compensation paid by an employing entity. I interpret NC statutes to indicate that the hourly rate of pay for part-time employees is covered by the term “salary” because it’s another type of compensation paid.

   

  Can you please provide me with either the hourly rate of pay, or the “total amount paid” to the employee in the previous year, for all Part-Time employees of CCCC — as this is a matter of public record.

This document includes the first name, last name, annual salary, title, and department name of each full-time employee in employment status with the college as of the beginning of the current fiscal year. No document exists that includes both this information and the hire date for full-time employees, and no similar document exists for part-time employees because our systems do not support salary information for part-time employees. We hope that this file will meet your needs; if there are any concerns, please let us know.
