** I’m simply requesting an electronic copy of an electronic record, if one exists. I’m NOT asking for the opportunity to come in person to "inspect", nor to obtain a printed copy of, this electronic record. I’m requesting explicitly that any responsive info be provided to me via the electronic medium / electronic format (in which the copy of this record should already exist). If you are unable to fulfill any or all parts of this request, please specifically cite where a reason for denial is justified under NC Public Records Law.**

Please provide the time, date, and brief description of the reason (for example: assist other agency, fire, assist EMS, wreck, etc.) for all calls to the Navassa Volunteer Fire Department. During the specific time period of 01/01/2023 through the present day [on the date that the query is performed].

To be clear, I’m only requesting to know the time / date / general description of a call. Please DO NOT include any personally identifying information about callers, if that type of data exists (for example: their name, phone #, an address, or case #, etc). That data is not relevant to my request, and Sunshine Request will not publish this type of info.

While we do proofread requests we receive for general spelling and clarity, we may choose not to fulfill the request if it is incomplete, or it is unclear what specific information the requester hopes to receive. In this case, the sender may rewrite and resubmit the request.

It’s the requester’s responsibility to write the request in a manner that clearly specifies a record that is being requested, and to what government entity it should be sent.

    Editor’s Note 02/29/24: We would like to clarify that the Town of Navassa, NC staff were very helpful throughout our efforts to try to get the Navassa Volunteer Fire Department [NVFD] to respond to our December 2023 public records request. 

     

    Our Team used various contact information for the NVFD, which was provided to us by the Town of Navassa Staff, but we were unable to get in touch with anyone at the NVFD. Our Team did not receive any response from the NVFD at any point from December 06, 2023 through February 07, 2024, and for that reason we had to mark the request as having been “Denied” by the NVFD.

     

    We would like to clarify and correct our previous statements in regard to the reason for the “Denial” of our December request. The Denial was related specifically to the Navassa Volunteer Fire Department’s non-response, and is not the fault of the Town of Navassa, NC (which we now understand is a separate entity). 

     

    On the advice of the Town of Navassa and Chief Williams, any future requests we submit related to the Navassa Volunteer Fire Department’s call data or statistics will be sent to the Brunswick County Dispatch.

    I submitted the following public records request to your offices on December 06, 2023:

    The email address listed online for the NVFD does not work ([email protected]), and the email account does not exist. I called the NVFD at (910) 371-9988 on 01/12/24 and left a voicemail reiterating my request, that Michelyn had also followed up with them in December, and also gave them my email address to contact me. I have not heard anything back. On 01/25/24 I also tried calling Minnie Brown (who may be the “Principal Officer” for the NVFD) at the phone number Michelyn provided. Minnie did not answer, and unfortunately it’s not possible to leave a voicemail, because her “voice mailbox has not been activated yet”.

     

    Under NC Public Records Law, the Town / NVFD is required to “promptly” process all public records requests. This essentially means that if you’ve intentionally delayed the fulfillment of a request by allowing it to “sit” until staff has availability to address it, or feels like answering my email and calls, then this could be considered a denial of a request. With this in mind, I want to highlight again the court case referenced in item #6 of the following article, posted on the NC Press Association website.     Having made all reasonable attempts to follow up, and having received no reply from anyone at NVFD (and having no other way to contact them) — I’m going to now mark this request as having been “Denied” by your organization and the NVFD. If you would like to respond to me in the future to fulfill the request, I’ll be happy to “reopen” it at that time.

     

    I would also like to suggest that the Town of Navassa and the NVFD revisit their current public records request fulfillment process to ensure that you’re in compliance with the Law, and that you fulfill and respond to all requests in a timely manner. There has got to be a more efficient way for the public to contact the NVFD, and to receive a response.

    As previously mentioned, the only email address I can find for NVFD does not work ([email protected]). Using the phone number Michelyn provided, (910) 371-9988, I called the Navassa Volunteer Fire Dept on 01/12. I left a voicemail explaining the situation about my request, how Michelyn has also followed up with them etc., and I gave them my email address to follow up with me. I have not heard back.

     

    I’m going to try to contact them again this week, but at that point I will have to mark this request as being “Denied” by their / your organization. There has got to be some way for the public to contact the Volunteer Fire Dept., and to receive a response via email.
