(December 2023) Request for Town of Navassa, NC Volunteer Fire Dept: Time, date, general description of all calls from 01/01/2023 – present day.

Good evening Town of Navassa, NC Volunteer Fire Department (or Records Officer), Michelyn and Claudia also CCed,

Please reply promptly to the following public records request, which I’m making in accordance with NC Public Records Law. https://www.ncleg.net/enactedlegislation/statutes/html/bychapter/chapter_132.html

** I’m simply requesting an electronic copy of an electronic record, if one exists. I’m NOT asking for the opportunity to come in person to "inspect", nor to obtain a printed copy of, this electronic record. I’m requesting explicitly that any responsive info be provided to me via the electronic medium / electronic format (in which the copy of this record should already exist). If you are unable to fulfill any or all parts of this request, please specifically cite where a reason for denial is justified under NC Public Records Law.**

If such a record exists –
Please provide the time, date, and brief description of the reason (for example: assist other agency, fire, assist EMS, wreck, etc.) for all calls to the Navassa Volunteer Fire Department. During the specific time period of 01/01/2023 through the present day [on the date that the query is performed].

To be clear, I’m only requesting to know the time / date / general description of a call. Please DO NOT include any personally identifying information about callers, if that type of data exists (for example: their name, phone #, an address, or case #, etc). That data is not relevant to my request, and Sunshine Request will not publish this type of info.
————————————

Please note that by submitting this request, I’m NOT agreeing to pay any potential fees or associated costs related to my request. If it isn’t possible to process the request without incurring fees, then please let me know the itemized potential cost and explanations for those charges upfront, and DO NOT proceed until I respond.

By Law I’m not required to provide a name or address to associate with a public records request, but in order to move things along I’d like to clarify that this request is being made by:

Sunshine Request
PO Box 17391
Asheville, NC 28816

The request has been sent solely by me and my email address [email protected] . If anyone other than that email address contacts you to pursue a similar request, it did not come from me. Please do not commingle or treat that as an alteration or cancellation of my request – I intend to continue to pursue my request.

Thank you for your assistance!

** Sunshine Request (www.sunshinerequest.com) makes no claim as to the veracity of any statements or information contained in any of the requests, or public records, we receive.

Editor’s Note: Sunshine Request makes no claim as to the veracity of any statements or information contained in any of the requests, or public records, we receive.

Editor’s Note 12/06/23: The submission above has been revised for clarity.

Sunshine Request will not fulfill the following types of requests:

☀️ Requests for public safety information specific to a single individual, address, incident or name.

This includes police reports, calls for service, complaints / incident reports / citations, criminal / arrest type records, or camera footage. We will, on a case by case basis, fulfill public safety related requests that focus on system-level trends and data.

Due to the personal nature of this type of information, we recommend that the sender reach out directly to the appropriate entity for assistance with the request.

☀️ Requests that are incomplete, non-specific, or vague.

While we do proofread requests we receive for general spelling and clarity, we may choose not to fulfill the request if it is incomplete, or it is unclear what specific information the requester hopes to receive. In this case, the sender may rewrite and resubmit the request.

It’s the requester’s responsibility to write the request in a manner that clearly specifies a record that is being requested, and to what government entity it should be sent.

☀️ Requests that are only informational questions, and requests that are not addressed to government entities.

Sunshine Request is a site built to make requests for public records to the government — Public records are recorded information such as documents, government emails, and data sets.

In the interest of preserving our team’s time to focus on the high volume of requests on our site, as well to respect the staff time of government entities fulfilling records requests, Sunshine Request will no longer fulfill “requests” that are just informational type questions for government entities to answer.

We also will not fulfill requests made to non-government entities.

It’s the requester’s responsibility to write the request in a manner that clearly specifies a record that is being requested, and to what government entity it should be sent.

☀️ Please be specific:

It is important that what you are requesting is specific and reasonable, and is an actionable records request. Please specify the exact type of records you’d like to receive, rather than any “possible” or “potential” info that could be searched. Remember that the larger your request, the more time it usually takes to fulfill. Specificity will often help reduce the amount of time needed to process the request.

It is important that a request has a clearly written and complete Subject and Message, and also specifies the Government Entity (or entities), City and/or County, and State to which the request should be sent. If applicable, please also include any responsive timelines for the info that should be requested.

While we do proofread requests we receive for general spelling and clarity, we may choose not to fulfill the request if it is incomplete, or it is unclear what specific info the requester hopes to receive, or if it violates our policies.

Before submitting a request, please take a moment to review our tips for How to write and make a successful request. If you have additional questions about our site or how to make requests, please check out our FAQs or Policies page.

☀️ Code of Conduct: Please do not use Sunshine Request or any of the results of public records requests to harass government entities / employees, businesses, private citizens / individuals, or otherwise.

☀️ Please note that we cannot pay any fees / associated costs related to any of the requests on our site. If it is not possible for a Government Agency to process our request without incurring fees, then it is the responsibility of that Agency to let us know what the potential costs may be — at which point we will ask that they cease processing the request. We will mark the request as “Completed” on our site, and the sender can contact the Government Agency directly, should they wish to further pursue a request.

Thank you for using Sunshine Request!

Good afternoon Michelyn, and all others CCed,

I submitted the following public records request to your offices on December 06, 2023:

    from: Sunshine Request <[email protected]>
    to: [email protected]
cc: [email protected], Claudia Bray <[email protected]>
    date: Dec 6, 2023, 6:54 PM
subject: Public records request. (December 2023) Request for Town of Navassa, NC Volunteer Fire Dept: Time, date, general description of all calls from 01/01/2023 – present day.

The email address listed online for the NVFD does not work ([email protected]), and the email account does not exist. I called the NVFD at (910) 371-9988 on 01/12/24 and left a voicemail reiterating my request, that Michelyn had also followed up with them in December, and also gave them my email address to contact me. I have not heard anything back. On 01/25/24 I also tried calling Minnie Brown (who may be the “Principal Officer” for the NVFD) at the phone number Michelyn provided. Minnie did not answer, and unfortunately it’s not possible to leave a voicemail, because her “voice mailbox has not been activated yet”.

Under NC Public Records Law, the Town / NVFD is required to “promptly” process all public records requests. This essentially means that if you’ve intentionally delayed the fulfillment of a request by allowing it to “sit” until staff has availability to address it, or feels like answering my email and calls, then this could be considered a denial of a request. With this in mind, I want to highlight again the court case referenced in item #6 of the following article, posted on the NC Press Association website. In this instance: “The trial court held that an unjustified one-month delay in production of records was tantamount to a denial”.  http://www.ncpress.com/stories/a-bakers-dozen-for-2022nc-public-records-law,2390

Having made all reasonable attempts to follow up, and having received no reply from anyone at NVFD (and having no other way to contact them) — I’m going to now mark this request as having been “Denied” by your organization and the NVFD. If you would like to respond to me in the future to fulfill the request, I’ll be happy to “reopen” it at that time.

I would also like to suggest that the Town of Navassa and the NVFD revisit their current public records request fulfillment process to ensure that you’re in compliance with the Law, and that you fulfill and respond to all requests in a timely manner. There has got to be a more efficient way for the public to contact the NVFD, and to receive a response.

    Hi Michelyn,

Thank you for your continued assistance.

According to Guidestar’s website — Minnie Brown may be the “Principal Officer” for the “Navassa Volunteer Fire Department”.
    https://www.guidestar.org/profile/56-2087959

Yesterday we tried calling Minnie at the phone number you provided. Minnie did not answer, and unfortunately it isn’t possible to leave her a voicemail or my contact info, because “the voice mailbox has not been activated yet”.

If you speak with her — please advise Minnie (or anyone else who can possibly fulfill my records requests to the Town of Navassa Volunteer Fire Dept.), to contact me via email at [email protected] . Or — please forward them my initial records request.

There has got to be a more efficient way for the public to contact either the Town or the Volunteer Fire Dept, and to receive a response via email. I submitted my initial request back on December 06, 2023.

    Thank you for your help!

Good afternoon Michelyn, Claudia, (and Mayor CCed),

Regarding my public records request. I submitted it to your offices in December 06, 2023:

    from: Sunshine Request <[email protected]>

As previously mentioned, the only email address I can find for NVFD does not work ([email protected]). Using the phone number Michelyn provided, (910) 371-9988, I called the Navassa Volunteer Fire Dept on 01/12. I left a voicemail explaining the situation about my request, how Michelyn has also followed up with them etc., and I gave them my email address to follow up with me. I have not heard back.

I’m going to try to contact them again this week, but at that point I will have to mark this request as being “Denied” by their / your organization. There has got to be some way for the public to contact the Volunteer Fire Dept., and to receive a response via email.
    https://townofnavassa.org/index.php/departments/fire-department

Under NC Public Records Law, the Town / NVFD is required to “promptly” process all public records requests. I am concerned if they are delaying or ignoring the fulfillment of my request by allowing it to “sit” until they have availability, or feel like replying to my messages. With this in mind, I want to highlight the court case referenced in item #6 of the following article, posted on the NC Press Association website. If you’re able to provide any additional assistance to help get my public records request fulfilled, it would be much appreciated.

    Thank you!

    Thanks for your help! 🙂

If I do not hear anything from The Volunteer Fire Department by the end of this week, then I will follow up with them (via phone) early next week. Surely, they have an email address that they regularly use to conduct their business, and that they are responsive to…

I will ask them for this email over the phone as well.

    Good afternoon Michelyn and Claudia,

    Please reply promptly.

I submitted the following public records request to your offices on December 06:

    from: Sunshine Request <[email protected]>

I received a bounceback notice at that time, which said that the email address [email protected] is an email account that “does not exist”.

That address was located on Brunswick County Gov’s website, and it was also the only address I could find online to email the Volunteer Fire Department.

I’d like to ask again that you please provide me with the correct email address to whom I should re-submit this public records request. Or, if you’re able to produce the responsive records I’ve requested yourselves, that would be great!

I will follow up again after the Holiday break, if I don’t hear back before then.

    Thank you for your help!

    Hi Michelyn and Claudia,

Just a moment ago I submitted a public records request to the email address [email protected] (<< contact info I found currently listed on the Brunswick County Government’s website). You were both CCed.

That email address is the only contact info I can find anywhere online for how to email the Volunteer Fire Department.

I just got a “bounceback” notification when I submitted my request. It says that the “email account that you tried to reach does not exist.”

Can someone please provide me with the correct contact information to whom I should submit a public records request related to the NVFD?

    Thank you for your help!
