Good evening Board of Trustees, Carolyn, Dr. Gossett, HR, AB Tech info, (Records Officer / Custodian(s) of these records).

I’m submitting this request to you all directly, as I believe you are the primary custodian(s) of these records, and therefore should now proceed to fulfill the request.

Please reply promptly to the following public records request, which I’m making in accordance with NC Public Records Law. https://www.ncleg.net/enactedlegislation/statutes/html/bychapter/chapter_132.html

I am aware that the Board of Trustees “Meeting Minutes" are available online: https://abtech.edu/about/board-trustees/minutes. Unfortunately, that webpage doesn't include any supplemental meeting documents, agendas, etc. With this in mind – please provide the electronic copies of all meeting materials (agendas, and Board member “handouts”) for September 09, October 23, November 04, and December 02, 2024.

Additionally – please clarify whether you have a “distribution list” to send these types of meeting materials on an ongoing basis? If so, please provide me with a link or instructions on how the public can go about signing up to receive that information.

** I’m simply requesting an electronic copy of an electronic record, if one exists. I’m NOT asking for the opportunity to come in person to "inspect", nor to obtain a printed copy of, this electronic record. I’m requesting explicitly that any responsive info be provided to me via the electronic medium / electronic format (in which the copy of this record already exists). If you are unable to fulfill any or all parts of this request, please specifically cite where a reason for denial is justified under NC Public Records Law. **

    I’ve noted that you would like for future records requests to be sent to you directly as PIO. I will do that.

     

    However, I would like to note that under NC Public Records Law, anyone who is a custodian of a public record may be required to fulfill a request. For example, if I wanted to request emails and text messages sent from John Gossett to other members of the Board of Trustees, I could technically submit the request directly to John — and he would be obligated to work with you to fulfill the request.

     

    I’ve reviewed the files above, and later this evening I will mark the request as “Completed” on our site.

    Attached are the requested items from A-B Tech’s Board of Trustees meetings in September, November and December 2024. The college was closed in October due to Helene and there were no meetings. Minutes from these meetings are posted on the following page: https://abtech.edu/about/board-trustees/minutes after they have been officially approved.

     

    Please note that A-B Tech was closed from December 20 to January 2. Also note that any further public records requests need to be sent to my attention as the official public information officer for A-B Tech. None of the people on the list are required to respond and all of them forwarded the requests to me per college policy. Please be aware that as the official respondent for A-B Tech, the PIO is the messenger. Decisions on what may be shared and when are determined by college leadership and, when appropriate, in consultation with our attorneys. State law does provide ample leeway on response times based on our official responsibilities and workload and, as you can imagine, A-B Tech has been quite busy with recovery efforts from Hurricane Helene. Our priority must always be our responsibility to serve our students, employees and community.

    This is my second attempt to follow up with you regarding my public records request, submitted to your offices on 12/13/24:
    (December 2024) Request for AB Tech Community College: Board of Trustees meeting agendas and handouts, September through December 2024.

     

    I have not received any response since submitting the request, nor to my follow up email about this on December 30.

     

    Under NC Public Records Law, you are required to “promptly” process all public records requests. Essentially, this means that if you intentionally delay the fulfillment of a request by allowing it to “sit” until staff has availability to address it, or feels like answering emails, then this could be considered a denial of a request. With this in mind, I want to highlight the court case referenced in item #6 of the following article, posted on the NC Press Association website.
