MESSAGE:
Please provide the electronic copy of City Attorney Andrea Leslie-Fite’s employment contract as approved by Council, and please provide the date of the meeting when the contract was approved in open session. I cannot find this information anywhere online. If there is no contract, then please provide the date of when the City plans to approve the contract in open session.

** I’m simply requesting an electronic copy of an electronic record, if one exists. I’m NOT asking for the opportunity to come in person to “inspect”, nor to obtain a printed copy of, this electronic record. I’m requesting explicitly that any responsive info be provided to me via the electronic medium / electronic format (in which the copy of this record already exists). If you are unable to fulfill any or all parts of this request, please specifically cite where a reason for denial is justified under NC Public Records Law. **

    In regard to the following (bolded for emphasis):

    I’ve been waiting for an answer to this question since December 16th. I’d like to highlight again the court case referenced in item #6 of the following article, posted on the NC Press Association website. In this instance: “The trial court held that an unjustified one-month delay in production of records was tantamount to a denial”, http://www.ncpress.com/stories/a-bakers-dozen-for-2022nc-public-records-law,2390. If the City intentionally delays the fulfillment of a request by allowing it to “wait” until staff has availability to address it, then this could be considered a denial of a request.

    In regard to the following public records request. I submitted to your offices on 12/04/2025:

    I’m still waiting for your answer as to whether that contract was approved in an open session, and if so when was that date? This should be very simple to answer.

     

    Trial courts have found that an unjustified 1 month delay in the production of records is tantamount to a denial. If I do not receive a response by February 08, I will mark the request as having been “Denied” by your organization.

    I submitted request # [REDACTED] to the City on 12/04/25 via JustFoia. On 12/05 @ 12:19pm “[email protected].com” sent me a message, and one responsive document. I asked the City for clarification about that document on 12/05 @ 12:39pm. I did not receive a response. At some point between 12/05 and 12/09, the document I saw was removed by the City. I followed up about this on 12/09, and still have not heard back.

    To reiterate:

    Please explain why that document was removed from JustFoia. Please add the responsive document back to the website.

     

    Additionally — as I indicated previously. In my request I also asked for the following:

    I’m asking again that you please provide the Title / Date of the Council (or other City) public meeting, where this contract was approved in an open-session? I do not see a record of any such meeting online, in council agenda / minutes etc.

     

    Under NC Public Records Law, your office is required to “promptly” process all public records requests. Essentially, this means that if you intentionally delay the fulfillment of a request by allowing it to “sit” until staff has availability to address it, or feels like answering my emails, then this could be considered a denial of a request. With this in mind, I want to highlight the court case referenced in item #6 of the following article, posted on the NC Press Association website.
