(February 2022) Request for Jackson County, NC Gov: Timesheets for Tax Administration staff 05/01/2019 – 02/28/2022

Hi Jackson County, NC Government (Records Officer),

I'd like to make a public records request for the following information under NC Public Records Law.

Please provide all timesheets for all Jackson County Tax Administration staff from May 01, 2019 through February 28, 2022. Jackson County Tax Administration is defined as "Tax Administrator, Assistant Tax Assessors, Mapping Specialists, Tax Collector, all Appraisers and Collection Clerks."

Please remove any personal identifying information that is not allowed to be shared, such as social security number. Please only exclude information that is required by law to be excluded.

If possible, please provide the information in a machine readable format (such as a csv, spreadsheet, pdf, jpg, etc.)

If you are unable to fulfill any or all parts of this request, please specifically cite where a reason for denial is justified under NC public records law.

    Jackson County’s timesheets incorporate leave and comp time information which cannot be separated or redacted as such hours pertain to the total hours for which the employee is paid. Therefore the exception applies to the entire record and disclosure is prohibited.

    Thank you again for your reply. Specifically:

     

    “Jackson County timesheets are considered part of the personnel file and therefore cannot be released in response to a public records request.”

     

    We’ve reviewed your response further, and would like to call your attention to these specific items from the article you cited:

     

    #3. “Is there an exception that applies? ( If not, the requested access must be provided. If so, continue to question 4.)” …


    … “Time sheets may include a mix of both types of information, including hours worked, as well as sick or vacation leave taken, and comp time used. According to Lawrence, time sheets that simply record hours worked are “prepared solely for payroll purposes” and should be considered financial rather than personnel records. These time sheets are fully subject to public access under the Public Records Law. But times sheets containing leave or comp time information should be considered part of the personnel file. Public Records at p. 158”

(If a prohibition applies to the entire record, do not disclose; if it applies only to certain information, redact and disclose.     With this in mind – Can you please specifically cite what specific elements of this article are justification for denial of the release of Jackson County employee timesheets? In other words – can you please clarify what it is about the timesheets you feel makes them “part of the personnel file” and that “cannot be released” under NC Public Records Law? We will note this information on our site.

     

    If there are some timesheets that can be released, we’d ask that you please do so.
