(February 2025) Request for City of Boiling Spring Lakes, NC Government: Related to parcel permits and possible “clear cutting of trees” 05/22/24 – 12/31/24.

Good afternoon Gordon, Suzanne, Tanya, Susan, David, Permitting, (Records Officer / Custodian(s) of these Records),

Please reply promptly to the following public records request, which I’m making in accordance with NC Public Records Law. https://www.ncleg.net/enactedlegislation/statutes/html/bychapter/chapter_132.html

I attempted to submit my request through your online records form. However, my request does not fit the character limit of the “Request” section of your form, and so I cannot submit it to you in your preferred format. Therefore, I’m submitting it to you all directly, as I believe you are the primary custodian(s) of these records, and should now proceed to fulfill the request.

All of the items requested below are related to Parcel # 15600025, and all of the responsive records for each item should include the specific time period of 05/22/2024 through 12/31/2024. Please provide the following:

A. The electronic copy of all permits requested, and all permits granted. This should also include tree survey.

B. Please indicate whether the City of Boiling Spring Lakes approved a clear cutting of trees on Parcel # 15600025 with Parcel # 15600118. If clear cutting was not approved, please provide any actions taken by the City of Boiling Spring Lakes.

** I’m simply requesting an electronic copy of an electronic record, if one exists. I’m NOT asking for the opportunity to come in person to "inspect", nor to obtain a printed copy of, this electronic record. I’m requesting explicitly that any responsive info be provided to me via the electronic medium / electronic format (in which the copy of this record already exists). If you are unable to fulfill any or all parts of this request, please specifically cite where a reason for denial is justified under NC Public Records Law. **
————————————

Please note that by submitting this request, I’m NOT agreeing to pay any potential fees or associated costs related to my request. If it isn’t possible to process the request without incurring fees, then please let me know the itemized potential cost and clear explanations of those charges upfront, and DO NOT proceed until I respond.

By Law I’m not required to provide a name or address to associate with a public records request, but in order to move things along I’d like to clarify that this request is being made by:

Sunshine Request
PO Box 17391
Asheville, NC 28816

The request has been sent solely by me and my email address [email protected] . If anyone other than that email address contacts you to pursue a similar request, it did not come from me. Please do not commingle or treat that as an alteration or cancellation of my request – I intend to continue to pursue my request.

Thank you for your assistance!

    Hi Tanya,

    Thank you for clarifying.

I assume your question may be related to the wording of this item in particular:

    B. Please indicate whether the City of Boiling Spring Lakes approved a clear cutting of trees on Parcel # 15600025 with Parcel # 15600118. If clear cutting was not approved, please provide any actions taken by the City of Boiling Spring Lakes.

I am unable to provide any additional information to further explain this aspect of the request. The responses you’ve provided me to this point are satisfactory, and I will now mark the request as “Completed” on our website.

    Thank you for your help!

    Good Afternoon,

I’m sorry we did not issue any permits for clear cutting on parcel # 15600025 and there has been no action taken by the City regarding that parcel #. Are you specifically looking for information on what permits were issued for parcel # 15600118?

    Thank you!
