However, my request literally does not fit into the form, so I cannot submit it to you in your preferred format. Therefore, I’m submitting it to you directly, as you are the primary custodian(s) of these records, and by Law should now proceed to fulfill the request.

Please see attached. Please note that this contract is for Manager Alice Derian. We have a new interim manager beginning March 30.
I am happy to explain why you are receiving your record today. When you submitted your record in February, it was third in line to be filled. North Topsail Beach fills requests in the order of which they were received, which the statute allows. I was already working on two record requests and did not have the ability to fill a third simultaneously. I did respond to your original request, but NCGS does not require me to respond to every check-in email I receive regarding requests. I have also been sick for multiple days of multiple weeks on and off since December. Unfortunately, I could not work while I was sick as it was mostly . Lastly, I was out last week on vacation. I hope you will accept my apology. Thanks for your patience.

Thanks for your message.
My request was submitted on February 12th. I was following up again as I hadn’t received a response since February 20th. I followed up with you on March 10th, and 19th, and did not receive a reply until March 23rd.
Under NC Public Records Law, your office is required to “promptly” process all public records requests. Essentially, this means that if you intentionally delay the fulfillment of a request by allowing it to “sit” until staff has availability to address it, or feels like answering my emails, then this could be considered a denial of a request. With this in mind, I want to highlight the court case referenced in item #6 of the following article, posted on the NC Press Association website. Can you please explain the delay in providing this very simple record, as well as when you expect it will be sent? Does the record even exist?

I submitted the following public records request to your office back on February 12th. It should be very simple to provide the following, and as Alice is also a custodian of this record, should be able to produce it as well:
“… electronic copy of the current employment contract for the Town of North Topsail Beach, NC Town Manager. Additionally, if it is not already indicated within the contract, please provide their current salary and any benefits they receive.”
Trial courts have found that an unjustified one month delay in the production of records is tantamount to a denial.
Having made reasonable efforts to follow up since February 19th — if I do not hear back in 1 week, I will need to mark this request as having been “Denied” by your organization.
