(January 2023) Request for NC Utilities Commission: NCUC “Voting Record”. 01/01/2015 – 01/18/2023.

Hello North Carolina Utilities Commission (Records Officer),

I'd like to make a public records request for the following information under NC Public Records Law

This request is related to the “NC Utilities Commission Voting Record”.

I’m hoping that you can please provide the “voting record” of the North Carolina Utilities Commission, particularly in regards to how the Commissioners have voted on matters pertaining to Duke Energy. During the specific time period of 01/01/2015 through 01/18/2023.

If any / all of this info is already publicly available online, please provide a link to where it can be accessed.

Please note: I am not requesting to come in person to inspect, nor to obtain printed copies of, electronic records. In accordance with NC Public Records Law, I’m requesting explicitly that all responsive records be provided via an electronic medium / format (in which the records should already exist), such as an email, file share, google drive folder, mailed flash drive if necessary, etc.

While we do proofread requests we receive for general spelling and clarity, we may choose not to fulfill the request if it is incomplete, or it is unclear what specific information the requester hopes to receive. In this case, the sender may rewrite and resubmit the request.

It’s the requester’s responsibility to write the request in a manner that clearly specifies a record that is being requested, and to what government entity it should be sent.

☀️ Requests that include profanity, personal statements, opinions, possibly defamatory statements, or other unnecessary info that is not relevant to making a records request.

Please do not include personal opinions and statements in the request’s Subject or Message. Please omit any extraneous statements that are not specific to the exact information you’d like to receive. This is not relevant information pertinent to the processing of a records request, and the request will not be published.

☀️ Please be specific:

It is important that what you are requesting is specific and reasonable, and is an actionable records request. Please specify the exact type of records you’d like to receive, rather than any “possible” or “potential” info that could be searched. Remember that the larger your request, the more time it usually takes to fulfill. Specificity will often help reduce the amount of time needed to process the request.

It is important that a request has a clearly written and complete Subject and Message, and also specifies the Government Entity (or entities), City and/or County, and State to which the request should be sent. If applicable, please also include any responsive timelines for the info that should be requested.

While we do proofread requests we receive for general spelling and clarity, we may choose not to fulfill the request if it is incomplete, or it is unclear what specific info the requester hopes to receive, or if it violates our policies.

    In response to the below request, the Commission issues orders when making decisions, and each Commissioner has approved the order unless otherwise indicated at the end of the order, such as dissenting, concurring, or not participating.

     

    “Duke Energy” has two electric utility subsidiaries in North Carolina, Duke Energy Carolinas (DEC) and Duke Energy Progress (DEP). All of the Commission’s orders going back to 1/1/2015 (even back to late 1996) are available on the Commission’s public website, https://www.ncuc.gov/. From the homepage, select either the Dockets menu item along the top, then Order Search from the dropdown menu, or select Docket Portal from farther down on the homepage, then Search for Orders from the top menu on the next page. Either way, you’ll come to a fill-in-the-blank form. There, fill in “E-7 Sub” in the Docket Number blank and a date range, and the docket system will return links to all the orders issued for DEC in that date range. Repeat the search with “E-2 Sub” for DEP orders. For example, for DEC, a search with a date range of 1/1/2015 to 1/18/2023 returns 1608 orders; for DEP, 1579. Each order may be examined by clicking on the “page” icon on the left side of each line in the results table.

     

    There is no single public record that provides a voting record as it appears you are requesting.
