(July 2021) Request for emails / contracts / future services between North Carolina Department of Public Instruction (NCDPI) and Panorama Education 01/01/20 – present

I'd like to make a multi-part public records request for the following information under NC Public Records Law:

1) Please provide all emails between Panorama Education and the NC Department of Public Instruction Procurement, Superintendent, and Equity Staff, from January 01, 2020 through Present (date the query is performed) regarding Panorama Education's alignment with NCStar Key Indicators for school improvement planning.

2) Additionally - please provide all contracts/agreements, along with quotes for future services, received by the North Carolina Department of Public Instruction from Panorama Education from January 01, 2020 through Present (date the query in performed).

For all requested items above, please provide all .pdfs, files, attachments, videos, hyperlinks, etc. that are indicated within the responsive records. For example: A .pdf that is an attachment within an email, should also be provided as a document along with the responsive emails.

There is no state-wide contract with Panorama at this time. It is currently being used in a handful of districts around the state, but since it is not a requirement of the state to use it we do not keep track of all those LEAs/public charters that do. Wanted to make sure you saw our last email from July 28th. I have pasted the message from that email below. I will make one more attempt to follow up on this request in September if I haven’t heard back by them.

It’s clear that the requester is asking for emails between certain NCDPI staff, and “Panorama Education”, and there are also subject matter and keywords specified. However, if you are unable to process Item 1 of the request without that additional information, please let us know!

Regarding all items and any fees for labor, please note Sunshine Request cannot commit to cover any fees associated with any public records requests received and sent through our site. If you determine that any fees need to be incurred in order to process any portion of the request, please send specific accounting making us aware of those potential costs and what they’re for, and please do not proceed with the request until you hear back from us.

In order to fulfill the request you submitted on July 21, 2021, we need more information for item one of your request. We have already begun working on item two of your request.

Also, as permissible within G.S. 132-6.2 (b), the NC Department of Public Instruction (NCDPI) reserves the right to charge for public records requested that require “extensive use of information technology resources or extensive clerical or supervisory assistance by personnel of the agency involved.” In these instances, we will seek to confirm if the requestor would like to proceed given the charges will be based on the labor of the personnel providing the services. For clarification, should this be the case with your request, this would only apply to the communication pull portion of your request, not item two of your request.
