(July 2023) Multi-part request for Onslow County, NC Government: Purchase documentation, and emails ranging from 01/01/2022 – 06/02/2023

Hello again Kevin (or Onslow County Records Officer), Julie, Angela, and Sharon,

I'd like to make a new, multi-part, public records request for the following information under NC Public Records Law.

** I’m simply requesting an electronic copy of an electronic record, if one exists. I am NOT asking to come in person to inspect, nor to obtain a printed copy of, these electronic records. I’m requesting explicitly that any responsive info be provided to me via an electronic medium / format (in which the copy of these records should already exist).

I do not have any additional or further clarifying info I wish to provide to narrow this request. If the request is unclear, or if you are unable to fulfill any or all parts of the request, then please specifically cite where a reason for its denial is justified under NC Public Records Law. **

This request is related to Onslow County purchase documentation, and emails ranging from 01/01/2022 - 06/02/2023.

If such a record exists –

A. Please provide the detailed budget documentation, bid documentation, invoices, and purchase order approval for the “emergency vehicle up fitting” referred to in Resolution 23-009 in regards to the censure of Commissioner Walter Scott.

B. Please provide all email communications sent between Sharon Griffin, County Admin Staff, and the County Commissioners, during the time period of of May 01, 2023 through June 02, 2023. This is not subject or keyword specific – I’d like “ALL emails exchanged” during that time period. (Note: Emails between these County Staff members and any Employees in other departments are not included in this portion of the request).

C. Please provide all emails sent TO Department Heads FROM County Admin Staff, during the time period of January 01, 2022 through June 02, 2023. Specifically – I’m requesting emails that include any or all of the the following keywords:
“ Commissioner ” , “ Commissioners ”, “ Commissioner Scott ”, “ Walter ” , “ Walter Scott ” , “Mr. Scott”

    This is my final attempt to follow up regarding this public records request. First submitted to your offices on July 3, 2023, 4:38 PM:

    In particular — this is my third time following up on my reply (Aug 07, 2:16 PM) sent to Kevin about “special service charges”. I have not received any response or clarification.

     

    I remain deeply concerned by your unwillingness to respond to questions about the fulfillment of public records requests. This is yet another one of several requests I’ve submitted to you over the past few months, which has continued to go unanswered or denied [by your lack of response].

     

    Under NC Public Records Law, the County is required to “promptly” process all public records requests. I remain deeply concerned that you may be intentionally delaying or ignoring the fulfillment of requests by allowing them to “sit” until staff has availability, or feels like addressing my emails. With this in mind, I want to highlight again the court case referenced in item #6 of the following article, posted on the NC Press Association website.     At the time the original request was received on our website in June 2023, the unedited version the sender wrote asked for:

     

    Please provide the detailed budget documentation, bid documentation, invoices, and purchase order approval for the emergency vehicle up fitting referred to in Resolution 23-009 in regards to the censure of Commissioner Walter Scott. Please include all email communications between Sharon Griffin, County Admin staff, and the County Commissioners during the timeframe of May 1, 2023 to June 2, 2023 as well. Emails between these county staff members and employees in other departments are not included in this portion of the request.     We revised the initial request for clarity, and when it was submitted to the County we asked them for following in Part A:

     

    A. Please provide the detailed budget documentation, bid documentation, invoices, and purchase order approval for the “emergency vehicle up fitting” referred to in Resolution 23-009 in regards to the censure of Commissioner Walter Scott.

     

    Given the complexity of the ongoing situation with the County about this, as well as other requests we had open with them on 07/20, it didn’t make sense to further complicate things by also asking them about Part A. We were still actively working to get clarity or resolution to all of our requests.

     

    Additionally. We are unable to further clarify that item to Kevin, if we were to follow up. It is unclear what other specific searchable records the sender is looking for. We feel that Item A was a bit vague in its wording, and we’re guessing Kevin fulfilled it to the best of his ability, as it was written. However, he didn’t indicate there was an issue with the way the item was written or ask us to clarify. He said on July 11 that, “Attached are the invoices requested in part A of the request.”

    I apologize for the delay.

     

    Thank you for the update back on Jul 21, 8:51AM regarding special service charges. Particularly:

     

    “ Over 2 ½ hours have been spent to determine what documents would be responsive to your request. At this time nearly 14,500 emails have been identified using the search criteria you chose. It is expected that many of the records will contain information that is not public record. In order to identify which records are public versus which records are not, an inordinate amount of staff time will be required to review the records.

     

    I have already requested that you clarify, narrow, or revise the request; however, it is my understanding that you are unwilling to do so. As such, in accordance with the attached policy a special service charge will be imposed. At this time Staff estimates it will take approximately 60 hours to fulfill your request, which will be no less than $1500 in Staff Time. If you would like to deposit the requested $1500 we can proceed forward with your request. Staff will keep track of their time and refund you if it takes less time than anticipated. Conversely, if it takes additional time above the $1500 deposit then you will be responsible for payment of same. ”

     

    Based on those notes – You’ve told me 2.5 hours have been spent to determine which documents are responsive, AND, you’ve also indicated that you have already determined the responsive records will contain protected documents. The good news is you were able to complete the 2 steps that are eligible for the special service charge, in 2.5 hours (which is less than your 3 hour limit).

     

    I understand you quoted a significant amount of staff time to complete fulfillment of this request. However, it’s clear to me all that’s left at this point is for you to separate public records from confidential info, and redact confidential information from the responsive records. According to both your policy, and NCGS § 132-6 – you cannot charge for the labor involved in reviewing records to determine what records or parts of records may be provided. I specifically understand that under § 132-6(c), “If it is necessary to separate confidential from nonconfidential information in order to permit the inspection, examination, or copying of the public records, the public agency shall bear the cost of such separation.”

     

    You cannot charge for the staff time, labor involved, or other legal fees required to review, redact, or separate confidential from non-confidential information in public records. That cost burden is yours to bear. Therefore, there should not be any associated fees.

     

    Please proceed with the original request as written. I’ll follow up again in another week, if I haven’t heard anything before then.

    ** I’m simply requesting an electronic copy of an electronic record, if one exists. I am NOT asking to come in person to inspect, nor to obtain a printed copy of, these electronic records. I’m requesting explicitly that any responsive info be provided to me via an electronic medium / format (in which the copy of these records should already exist).

     

    I do not have any additional or further clarifying info I wish to provide to narrow this request. If the request is unclear, or if you are unable to fulfill any or all parts of the request, then please specifically cite where a reason for its denial is justified under NC Public Records Law. **

     

    This request is related to Onslow County purchase documentation, and emails ranging from 01/01/2022 – 06/02/2023.

     

    If such a record exists –

     

    A. Please provide the detailed budget documentation, bid documentation, invoices, and purchase order approval for the “emergency vehicle up fitting” referred to in Resolution 23-009 in regards to the censure of Commissioner Walter Scott.

     

    B. Please provide all email communications sent between Sharon Griffin, County Admin Staff, and the County Commissioners, during the time period of of May 01, 2023 through June 02, 2023. This is not subject or keyword specific – I’d like “ALL emails exchanged” during that time period. (Note: Emails between these County Staff members and any Employees in other departments are not included in this portion of the request).

     

    C. Please provide all emails sent TO Department Heads FROM County Admin Staff, during the time period of January 01, 2022 through June 02, 2023. Specifically – I’m requesting emails that include any or all of the the following keywords:
    “ Commissioner ” , “ Commissioners ”, “ Commissioner Scott ”, “ Walter ” , “ Walter Scott ” , “Mr. Scott”
