(July 2023) Multi-part request for Onslow County, NC Government: Purchase documentation, and emails ranging from 01/01/2022 – 06/02/2023

Hello again Kevin (or Onslow County Records Officer), Julie, Angela, and Sharon,

I'd like to make a new, multi-part, public records request for the following information under NC Public Records Law.
Ref: https://www.ncleg.net/enactedlegislation/statutes/html/bychapter/chapter_132.html

** I’m simply requesting an electronic copy of an electronic record, if one exists. I am NOT asking to come in person to inspect, nor to obtain a printed copy of, these electronic records. I’m requesting explicitly that any responsive info be provided to me via an electronic medium / format (in which the copy of these records should already exist).

I do not have any additional or further clarifying info I wish to provide to narrow this request. If the request is unclear, or if you are unable to fulfill any or all parts of the request, then please specifically cite where a reason for its denial is justified under NC Public Records Law. **

This request is related to Onslow County purchase documentation, and emails ranging from 01/01/2022 - 06/02/2023.

If such a record exists –

A. Please provide the detailed budget documentation, bid documentation, invoices, and purchase order approval for the “emergency vehicle up fitting” referred to in Resolution 23-009 in regards to the censure of Commissioner Walter Scott.

B. Please provide all email communications sent between Sharon Griffin, County Admin Staff, and the County Commissioners, during the time period of of May 01, 2023 through June 02, 2023. This is not subject or keyword specific – I’d like “ALL emails exchanged” during that time period. (Note: Emails between these County Staff members and any Employees in other departments are not included in this portion of the request).

C. Please provide all emails sent TO Department Heads FROM County Admin Staff, during the time period of January 01, 2022 through June 02, 2023. Specifically – I’m requesting emails that include any or all of the the following keywords:
“ Commissioner ” , “ Commissioners ”, “ Commissioner Scott ”, “ Walter ” , “ Walter Scott ” , “Mr. Scott”

If any / all of this info is already publicly available online, please provide a link to where it can be accessed.
——————

Please note that by submitting this request, I am NOT agreeing to pay any potential fees or associated costs related to my request. If it is not possible to process the request without incurring fees, then please let me know the itemized potential cost and explanations for those charges upfront, and DO NOT proceed until I can respond.

By Law I am not required to provide a name or address to associate with a public records request, but in order to move things along I’d like to clarify that this request is being made by:

Sunshine Request
PO Box 17391
Asheville, NC 28816

The request has been sent solely from the email address [email protected] . If anyone other than that email address contacts you to pursue a similar request, it did not come from me or my Team. Please do not commingle or treat that as an alteration or cancellation of my request – I intend to continue to pursue my request.

Thank you for your assistance!

Editor’s Note: Sunshine Request makes no claim as to the veracity of any statements or information contained in any of the requests, or public records, we receive.

06/30/23 Editor’s Note: The submission above has been revised for clarity. As it was written originally, it was not clear what specific records the sender would like to receive. We have attempted to re-write the request. However, if Onslow County needs any of the information to be clarified in order to process the request, then they will let us know.

Sunshine Request will not fulfill the following types of requests:

☀️ Requests that are incomplete, non-specific, or vague.

While we do proofread requests we receive for general spelling and clarity, we may choose not to fulfill the request if it is incomplete, or it is unclear what specific information the requester hopes to receive. In this case, the sender may rewrite and resubmit the request.

It’s the requester’s responsibility to write the request in a manner that clearly specifies a record that is being requested, and to what government entity it should be sent.

☀️ Please be specific:

It is important that what you are requesting is specific and reasonable, and is an actionable records request. Please specify the exact type of records you’d like to receive, rather than any “possible” or “potential” info that could be searched. Remember that the larger your request, the more time it usually takes to fulfill. Specificity will often help reduce the amount of time needed to process the request.

It is important that a request has a clearly written and complete Subject and Message, and also specifies the Government Entity (or entities), City and/or County, and State to which the request should be sent. If applicable, please also include any responsive timelines for the info that should be requested.

While we do proofread requests we receive for general spelling and clarity, we may choose not to fulfill the request if it is incomplete, or it is unclear what specific info the requester hopes to receive, or if it violates our policies.

Before submitting a request, please take a moment to review our tips for How to write and make a successful request. If you have additional questions about our site or how to make requests, please check out our FAQs or Policies page.

☀️ Please note that we cannot pay any fees / associated costs related to any of the requests on our site. If it is not possible for a Government Agency to process our request without incurring fees, then it is the responsibility of that Agency to let us know what the potential costs may be — at which point we will ask that they cease processing the request. We will mark the request as “Completed” on our site, and the sender can contact the Government Agency directly, should they wish to further pursue a request.

☀️ Code of Conduct
Please do not use Sunshine Request or any of the results of public records requests to harass government entities / employees, businesses, private citizens / individuals, or otherwise.

Thank you for using Sunshine Request!

subject: Re: Records Request: (July 2023) Multi-part request for Onslow County, NC Government: Purchase documentation, and emails ranging from 01/01/2022 – 06/02/2023

Good Afternoon Kevin, and all CCed,

This is my final attempt to follow up regarding this public records request. First submitted to your offices on July 3, 2023, 4:38 PM:
(July 2023) Multi-part request for Onslow County, NC Government: Purchase documentation, and emails ranging from 01/01/2022 – 06/02/2023

In particular — this is my third time following up on my reply (Aug 07, 2:16 PM) sent to Kevin about “special service charges”. I have not received any response or clarification.

I remain deeply concerned by your unwillingness to respond to questions about the fulfillment of public records requests. This is yet another one of several requests I’ve submitted to you over the past few months, which has continued to go unanswered or denied [by your lack of response].

Under NC Public Records Law, the County is required to “promptly” process all public records requests. I remain deeply concerned that you may be intentionally delaying or ignoring the fulfillment of requests by allowing them to “sit” until staff has availability, or feels like addressing my emails. With this in mind, I want to highlight again the court case referenced in item #6 of the following article, posted on the NC Press Association website. In this instance: “The trial court held that an unjustified one-month delay in production of records was tantamount to a denial”. http://www.ncpress.com/stories/a-bakers-dozen-for-2022nc-public-records-law,2390

Having made all reasonable attempts to follow up with you, I’m going to now mark this request as having been “Denied” by your organization.

I would highly recommend that the County revisits their current public records request fulfillment process to ensure that you’re in compliance with the Law, and that you fulfill and respond to all requests in a timely manner.

    Thank you.

    ~ The Sunshine Request Team

09/07/23. Editor’s Note to Sender: The request above has been marked as “Denied”. This is due to Onslow County’s lack of response.

We received a follow-up submission from someone via our website on 07/20/23, which read as follows:

    Date sent in to Sunshine:
    07/20/23

    Original Subject:
Onslow County Purchasing Documents referred to in Resolution 23-009

    Original Message:
Please provide the detailed budget documentation, bid documentation, and purchase order approval for the “emergency vehicle up fitting” referred to in Resolution 23-009 in regards to the censure of Commissioner Walter Scott. These were excluded from a previous request.

    Government Entity:
    Other (indicate in message)

    Start Date / End Date:
    N/A – N/A. Blank.

This person is referring to “Part A.” from the request we sent the County on 07/03/23.

At the time the original request was received on our website in June 2023, the unedited version the sender wrote asked for:

Please provide the detailed budget documentation, bid documentation, invoices, and purchase order approval for the emergency vehicle up fitting referred to in Resolution 23-009 in regards to the censure of Commissioner Walter Scott. Please include all email communications between Sharon Griffin, County Admin staff, and the County Commissioners during the timeframe of May 1, 2023 to June 2, 2023 as well. Emails between these county staff members and employees in other departments are not included in this portion of the request. Please provide any emails to department heads from county admin staff between January 1, 2022  and June 2, 2023 that includes the words Commissioner, Commissioners, Commissioner Scott, Walter, and/or Walter Scott”

We revised the initial request for clarity, and when it was submitted to the County we asked them for following in Part A:

    A. Please provide the detailed budget documentation, bid documentation, invoices, and purchase order approval for the “emergency vehicle up fitting” referred to in Resolution 23-009 in regards to the censure of Commissioner Walter Scott.

Given the complexity of the ongoing situation with the County about this, as well as other requests we had open with them on 07/20, it didn’t make sense to further complicate things by also asking them about Part A. We were still actively working to get clarity or resolution to all of our requests.

Additionally. We are unable to further clarify that item to Kevin, if we were to follow up. It is unclear what other specific searchable records the sender is looking for. We feel that Item A was a bit vague in its wording, and we’re guessing Kevin fulfilled it to the best of his ability, as it was written. However, he didn’t indicate there was an issue with the way the item was written or ask us to clarify. He said on July 11 that, “Attached are the invoices requested in part A of the request.”

This info. comes from our FAQs page:

Who should I contact if I think there are results of requests that have been improperly disclosed or should be redacted?
The results of all Completed requests are published on our site, and have been provided to Sunshine Request directly by the disclosing government agency (government entity).

Sunshine Request’s policy in situations involving an alleged improper disclosure is to refer you to the disclosing agency (government entity). If any party feels that an alleged improper disclosure has taken place, please contact the disclosing agency (government entity) directly.

If the disclosing agency, after a review of your case, determines that confidential information was improperly disclosed, and notifies us of such disclosure, we will then be able to review your case.

Similarly — Sunshine Request has reviewed any info given to us from Onslow County to determine if it satisfies the initial request. We make no claim as to the veracity of records / responses we receive from Entities. If you have reason to believe the County has improperly disclosed (or is not disclosing) all available public records in accordance with NC Public Records Law, we encourage you to reach out to them directly.

I have not received a response to that message, nor to my follow up email on August 16.

Under NC Public Records Law, the County is required to “promptly” process all public records requests. Having made all reasonable attempts to follow up with you, if I do not hear back in 1 week — at that point, I will mark this request as having been “Denied” by your organization. And I will consider my next steps to address this matter with your County Manager and Board, from there.

    Thank you.

    Hi Kevin,

    I apologize for the delay.

Thank you for the update back on Jul 21, 8:51AM regarding special service charges. Particularly:

“ Over 2 ½ hours have been spent to determine what documents would be responsive to your request. At this time nearly 14,500 emails have been identified using the search criteria you chose. It is expected that many of the records will contain information that is not public record. In order to identify which records are public versus which records are not, an inordinate amount of staff time will be required to review the records.

I have already requested that you clarify, narrow, or revise the request; however, it is my understanding that you are unwilling to do so. As such, in accordance with the attached policy a special service charge will be imposed. At this time Staff estimates it will take approximately 60 hours to fulfill your request, which will be no less than $1500 in Staff Time. If you would like to deposit the requested $1500 we can proceed forward with your request. Staff will keep track of their time and refund you if it takes less time than anticipated. Conversely, if it takes additional time above the $1500 deposit then you will be responsible for payment of same. ”

Based on those notes – You’ve told me 2.5 hours have been spent to determine which documents are responsive, AND, you’ve also indicated that you have already determined the responsive records will contain protected documents. The good news is you were able to complete the 2 steps that are eligible for the special service charge, in 2.5 hours (which is less than your 3 hour limit).

I understand you quoted a significant amount of staff time to complete fulfillment of this request. However, it’s clear to me all that’s left at this point is for you to separate public records from confidential info, and redact confidential information from the responsive records. According to both your policy, and NCGS § 132-6 – you cannot charge for the labor involved in reviewing records to determine what records or parts of records may be provided. I specifically understand that under § 132-6(c), “If it is necessary to separate confidential from nonconfidential information in order to permit the inspection, examination, or copying of the public records, the public agency shall bear the cost of such separation.”

You cannot charge for the staff time, labor involved, or other legal fees required to review, redact, or separate confidential from non-confidential information in public records. That cost burden is yours to bear. Therefore, there should not be any associated fees.

Please proceed with the original request as written. I’ll follow up again in another week, if I haven’t heard anything before then.

    Thank you!

    ~ The Sunshine Request Team

    Hi Kevin,

    Thanks for checking.

I do not have additional or further clarifying info I wish to provide to narrow parts B. and C. of this request.

If the request is unclear, or if you’re unable to fulfill any or all parts of the request, please specifically cite where a reason for its denial is justified under NC Public Records Law. If it is not possible to process the request without incurring fees, then please let me know the itemized potential cost and explanations for those charges upfront, and do not proceed until I can respond.

Please provide a clear description / explanation of the exact fees and totals you feel may be required for the request, as well as where they are justified under the Law. At that point, we’ll review your response as a Team, and will consider our next steps from there.

    Thank you!

    Thank you!

    Greetings,

We have received your request. Attached are the invoices requested in part A of the request. We are still assessing the number of records that may be responsive to parts B and C of the request in order to determine if they are extensive enough to require special service charges. Given the broad timeframe specified in part C of the request, staff time to fulfill this request may exceed three hours after which point a special service charge is applied. Is it possible to clarify or revise the request in order to more accurately find the document you are seeking?

    Respectfully,

Hello again Kevin (or Onslow County Records Officer), Julie, Angela, and Sharon,

I’d like to make a public records request for information that may be available in your office.

If you’re not the appropriate party to contact about the request, please provide the correct name and email address of whom I should send it to.

Please confirm receipt to let me know the request will begin processing, and if possible, please provide a rough estimate of when the request may be completed. I will plan on following up again soon if I have not heard back before then.

Here are the details of the request:

Subject: (July 2023) Multi-part request for Onslow County, NC Government: Purchase documentation, and emails ranging from 01/01/2022 – 06/02/2023

Message: “Hello again Kevin (or Onslow County Records Officer), Julie, Angela, and Sharon,

I’d like to make a new, multi-part, public records request for the following information under NC Public Records Law.

This request is related to Onslow County purchase documentation, and emails ranging from 01/01/2022 – 06/02/2023.

    Thank you for your assistance!”

    Thank you!
