(July 2024) Request for Town of Pacolet, SC: Related to “the Pacolet Thread” financial records. From 03/01/2023 – present day.

Good afternoon Toni, Patrick, Jennifer, (or Records Officer / Custodian(s) of these Records),

Please reply promptly to the following public records request, which I’m making in accordance with South Carolina Public Records Law / FOIA / Sunshine Law. My request does not fit into any of the forms on your website, and therefore I am submitting it to you all directly, as I believe you are the primary custodian(s) of these records.

This request is related to Financial Records of the Pacolet Thread, a 501(c)3. I believe that donations have been used to fund Town of Pacolet, SC events.

In the following document, “Town of Pacolet Council Meeting June 1, 2023”, it is stated that:
“... The nonprofit organization named the Pacolet Thread, which was started last fall, has been approved by the IRS as an approved 501c3. He would like to request that all events are administered through the 501c3 organization with partnership from the Town of Pacolet. With the IRS nonprofit status, donations to the event would be considered tax deductible for both state and federal, so he is suggesting that all financial transactions are done through this organization. Financial reports and annual reports of the organization would be provided to the council monthly. The board is currently made up of five seats that can be expanded as the need arises. I believe that the Articles of Incorporation for the Pacolet Thread name Patrick Kay (Pacolet, SC Town Administrator) as the incorporator or registered agent of the 501(c)3 – along with the following contact info: Patrick Kay, 180 Montgomery Ave, Pacolet SC 29372, (864) 474-9504. This is the same address as Pacolet Town Hall.

Please provide the electronic copies of the Financial Records for “the Pacolet Thread” from March 01, 2023 through the present day (on the date the query is performed).

** I’m simply requesting an electronic copy of an electronic record, if one exists. I’m NOT asking for the opportunity to come in person to "inspect", nor to obtain a printed copy of, this electronic record. I’m requesting explicitly that any responsive info be provided to me via the electronic medium / electronic format (in which the copy of this record should already exist). If you are unable to fulfill any or all parts of this request, please specifically cite where a reason for denial is justified under SC Public Records Law. **

    Thank you for your reply.

     

    As I stated when I submitted the request — My request literally does not “fit” into your FOIA form [I did try to fill it out], so I’m unable to submit it to you in the manner that you’d prefer.

     

    For this reason, I submitted the request to you, Toni, and Jennifer directly via email. I believe that you are the primary custodians of these records, and therefore should be able to proceed to process the request.

     

    I acknowledge that your FOIA form indicates a fee schedule for certain types of requests. As I also stated when I submitted the request — “… Please note that by submitting this request, I’m NOT agreeing to pay any potential fees or associated costs related to my request. If it isn’t possible to process the request without incurring fees, then please let me know the itemized potential cost and explanations for those charges upfront, and DO NOT proceed until I respond.”

     

    I would not like to receive an “invoice” from you, since I do not intend to pay any fees related to this request. Instead, it would be very helpful if you can please explain what the specific cost breakdown is that you’ve determined would be necessary to fulfill the request. Once I have that info,
    I will note this on our website, and we can “Close” the request.
