(June 2020) Request for info related to police contracts and correspondence between police unions and the City of Asheville, NC

Hello City of Asheville, NC Government (APD),

I’d like to make a public records request for the following information:

I’m interested in information about how police unions help local departments negotiate terms of their contract with the city, and I’d like to know what the contract between the Asheville Police Department and the City of Asheville looks like. Specifically, I’d like to know how the contract was formed, and what kinds of negotiations occurred between police unions and staff working on behalf of the City of Asheville to create the contracts.

Please provide a copy of all current contracts [as of 06/07/2020] between the City of Asheville and the Asheville Police Department.

Additionally, please provide any written correspondence [from 06/07/2015 - 06/07/2020] regarding how those contracts were formed.

    Dear Sunshine Request:
    Pursuant to North Carolina Law, there are no police unions in North Carolina. Please see N.C.G.S. § 95-98. Contracts between units of government and labor unions, trade unions or labor organizations concerning public employees declared to be illegal.
    Any agreement, or contract, between the governing authority of any city, town, county, or other municipality, or between any agency, unit, or instrumentality thereof, or between any agency, instrumentality, or institution of the State of North Carolina, and any labor union, trade union, or labor organization, as bargaining agent for any public employees of such city, town, county or other municipality, or agency or instrumentality of government, is hereby declared to be against the public policy of the State, illegal, unlawful, void and of no effect. (1959, c. 742.)”
