(June 2025) Request for Southwestern Community College, in NC: Board of Trustees closed session meeting minutes and recordings 01/01/2023 – 05/31/2025.
Good afternoon Don, Tyler, Bryan, (Records Officer / Custodian(s) of these Records),
Please reply promptly to the following public records request, which I’m making in accordance with NC Public Records Law. https://www.ncleg.net/enactedlegislation/statutes/html/bychapter/chapter_132.html
Please provide the electronic copy of all “meeting minutes” and “audio recordings” for all Closed Session meetings of the SCC Board of Trustees during the time period of January 01, 2023 through May 31, 2025. Specifically – any of those minutes and recordings that are no longer sealed, or are otherwise determined to be eligible for public release, where the release of such records would not frustrate the purpose of the original closed session discussion.
In regard to audio. This refers to recordings [if they exist] of the Closed Session meetings, particularly if used to create meeting minutes or transcriptions.
If any portion of the requested records is deemed confidential or exempt from disclosure, please redact only the specific exempt content and provide the remainder of the records in unredacted form. If an audio file contains exempt content, please redact that portion of the audio (e.g., by muting or bleeping) and provide the remaining non-exempt portions.
Additionally, for any redacted materials, please cite the specific exemption(s) under N.C. Gen. Stat. § 132-1.2 or other applicable statute(s) that justify the redaction or withholding.
Please note that under N.C. Gen. Stat. § 132-3(a) and G.S. § 121-5(b), public records may not be destroyed or altered once a request for them has been made. If the requested audio files still exist, they should not be deleted or altered, and I request copies of them. If they have already been lawfully disposed of in accordance with a retention schedule, please confirm the date and method of destruction.
I request that the records be provided in electronic format.
** I’m simply requesting an electronic copy of an electronic record, if one exists. I’m NOT asking for the opportunity to come in person to "inspect", nor to obtain a printed copy of, this electronic record. I’m requesting explicitly that any responsive info be provided to me via the electronic medium / electronic format (in which the copy of this record already exists).**
