Please reply promptly to the following public records request, which I’m making in accordance with NC Public Records Law. https://www.ncleg.net/enactedlegislation/statutes/html/bychapter/chapter_132.html

This request relates to Social media policies, misuse of systems, or abuse of authority for Rockingham County NC employees. To be clear – I am not asking to receive any personally identifying information about victims, case numbers, addresses, potentially defamatory statements, etc. — if that type of information happens to be contained in any of the responsive records.

Please provide the following:

A. All current policies and procedures governing employee access to law enforcement or communications databases, including any policies regarding misuse, unauthorized access, or use for personal purposes.

B. Any policies, procedures, or protocols requiring notification, reporting, or escalation when an employee is suspected of misuse of systems or abuse of authority.

C. Any internal audit policies, audit logs, or reports related to employee access or use of dispatch or communications systems (including C-COMM), from January 01, 2026 to present day.

D. Any records reflecting complaints, investigations, or disciplinary actions related to misuse of systems or unauthorized information access within the communications/dispatch department, from January 01, 2026 to present day. To the extent such records are public.

E. A list of current employees within the communications/dispatch department, including:
- First / Last Name
- Date of hire
- Current position / title
- Salary (or hourly rate. whichever pay structure is applicable to the employee)
- Dates of promotions or position changes

F. Any social media policies applicable to county employees.

If any portion of these records is exempt from disclosure, please provide the non-exempt portions, and cite the legal basis for any redactions or withholding.

** I’m simply requesting an electronic copy of an electronic record, if one exists. I’m NOT asking for the opportunity to come in person to “inspect”, nor to obtain a printed copy of, this electronic record.     I’m not an AI robot as you seem to be suggesting. Rockingham County has fulfilled many public records I’ve submitted in the past.

     

    You are mistaken re: Public Records Law. I’ve submitted the request to the custodian(s) of those records, and you are required to proceed to fulfill the request.

     

    § 132-6. Inspection, examination and copies of public records.
    (a) Every custodian of public records shall permit any record in the custodian’s custody to be inspected and examined at reasonable times and under reasonable supervision by any person, and shall, as promptly as possible, furnish copies thereof upon payment of any fees as may be prescribed by law …
    (a1) A public agency or custodian may satisfy the requirements in subsection (a) of this section by making public records available online in a format that allows a person to view the public record and print or save the public record to obtain a copy. If the public agency or custodian maintains public records online in a format that allows a person to view and print or save the public records to obtain a copy, the public agency or custodian is not required to provide copies to these public records in any other way.

     

    § 132-6.2. Provisions for copies of public records; fees.
    (a) Persons requesting copies of public records may elect to obtain them in any and all media in which the public agency is capable of providing them. No request for copies of public records in a particular medium shall be denied on the grounds that the custodian has made or prefers to make the public records available in another medium. The public agency may assess different fees for different media as prescribed by law.

    The UNC School of Government has also weighed in on this topic, stating clearly that while government agencies may ask requesters to fill out a form, there’s no legal basis in NC Statute to compel requesters to complete additional steps:

     

    “While the North Carolina public records law does not specifically authorize local governments to require that public records requests must be submitted in a particular form, there are legitimate reasons to request information that will help the agency fulfill its legal obligations in providing access to public records. But if the agency has the minimum information it needs, it must respond, even if a request is not submitted in the standard form.”

    By Law, it is not required that I must submit a public records request to you in your “preferred” format. Rather, it is a courtesy if I choose to do so.

     

    Since I’ve already submitted the request directly to the custodian(s) of these records [yourself, Clyde, Derek and Lance], by Law you are now obligated to proceed to fulfill the request.

     

    In the future, I will keep in mind that there is a form on your site that you’d prefer I use to submit requests.

    This has been an ongoing issue since at least November of 2025.

    How to Fix It

    It appears you aren’t in the same organization as the group (or a sub-group) you’re sending to or your email address isn’t on the group’s allowed senders list. Ask the owner of the group to grant you permission to send to it, and then try again. If the group belongs to a different organization than yours, contact the organization’s customer service department for assistance. If the group is in your organization and you don’t know who the group owner is, you can find it by doing the following in either Outlook on the web or Outlook:

     

    – Open your Sent folder and select the original message.

    – If you’re using Outlook on the web, select the group name located on the To or CC line. If you’re using Outlook, double-click the group name located on the To or CC line.

    – In Outlook on the web, from the pop-up dialog box, choose Owner. In Outlook, choose Contact. The owner’s name is listed under Owner.

     

    The owner of the group may have intentionally chosen to restrict who can send messages to it, and they may not want to adjust the existing restriction.     This error occurs when the distribution group, security group, or Microsoft 365 group is configured to accept messages only from authenticated senders (senders in the same organization or those added to the group’s allowed senders list).

     

    To fix the issue, the recipient’s email admin or the group owner must add the sender’s email address to the group’s allowed senders list or change the group’s delivery management setting to accept messages from senders inside and outside of the organization.
