(March 2022) Request for Asheville City Schools: All text messages and emails sent to and from ACS Board Members, Superintendent, and Deputy Superintendent. 11/19/2021 – 12/31/2021.

Hello Asheville, NC City Schools (Public Records Officer) and IT Department CCed,

I'd like to make a public records request for the following information under NC Public Records Law.
Ref: https://www.ncleg.net/enactedlegislation/statutes/html/bychapter/chapter_132.html

Please provide all text messages (SMS and MMS) and all emails sent to and sent from Asheville City Schools Board Members, ACS Superintendent, and ACS Deputy Superintendent. During the specific time period of 11/19/2021 through 12/31/2021. This request is not subject or keyword specific – I’d like to receive ALL responsive records during the time period requested.

Please include all .PDFs, files, attachments, videos, hyperlinks, etc. that are indicated within the responsive records. For example: A .PDF that is an attachment within an email, should also be provided as an accompanying file along with the responsive emails.

Emails and text messages already exist in a digital format (electronic medium). Therefore, you should be able to provide those records as requested under NC Public Records Law. You should also be able to provide these records in an electronic format such as Google Drive link, Dropbox folder, emailed response, .PDF, CD / Flash drive (if necessary), or other electronic format.

    Hi Mark,

     

    Thank you for your reply, and for providing recommendations to further clarify the request.

     

    Although I don’t have additional information to provide other than what was submitted to our site by the sender, I do interpret that it is intentional the sender is not asking for subject specific records – They would like to receive any and all texts and emails sent during the time period requested.

     

    I understand that the request as written would be time-intensive to fulfill and redact. That is fine with me! However, since you’ve indicated it would be helpful if the sender could narrow down the subject matter requested, we will mark this request as “Completed” for now, and will note the info you’ve provided on our website.

     

    If the sender would like to further narrow the scope of the request, they are encouraged to do so via our website, or can reach out to you and ACS directly if they’d like to proceed with the request on their own.

     

    I’d just like to note though, that if the sender does resubmit and it turns out the records they’re requesting are not going to be subject specific – Then we would still ask that you provide an estimated timeline for fulfillment of the request (whether that’s weeks, months, etc).

This request is overly broad and fails to identify the public records that are requested to be inspected. In addition, responding to this request will require ACS to review thousands of communications in order to redact confidential student and personnel information.     I’d like to make a public records request for information that may be available in your office.

     

    In the past, we’ve sent these requests to Ashley Thublin, but as of late we’ve never heard back from her on our latest requests after multiple follow ups with Dillon Huffman CC’d. We’ve had to mark these requests as denied, but we’d really appreciate it if you could provide the appropriate email to send these requests to if Ashley is not the appropriate contact.

     

    Please confirm receipt to let me know the request will begin processing, and if possible, please provide a rough estimate of when the request may be completed. I will plan on following up again in mid-April if I have not heard back before then.
