(March 2024) Request for City of Boiling Spring Lakes, NC Government: “GPS activity data” logs for Chief of Police and all Sergeants. From 03/05/24 – 03/19/24.

Good evening Kevin, Gordon, Nancy, and Susan, (or Custodian(s) of these records),

Please reply promptly to the following public records request, which I’m making in accordance with NC Public Records Law. https://www.ncleg.net/enactedlegislation/statutes/html/bychapter/chapter_132.html

Please provide the “GPS activity data” logs for all vehicles used by the Chief of Police and all Sergeants of the Boiling Spring Lakes Police Department, during the specific time period of 03/05/24 through 03/19/24.

I acknowledge that in a similar recent records request the City explained that in 2023 they used a GPS platform called “Networkfleet” – which to the best of your knowledge had a “7 day retention period” … “set by the vendor” and was “not adjustable” on the City’s end. I assume the City is still using the same GPS platform in 2024, and if so I’d like to note the short 7 day retention window makes it very difficult to request these public records. With this in mind – I believe I’ve indicated a long enough time period that the City should be able to provide me with 7 days worth of requested GPS activity data, at any point from 03/05/24 through 03/19/24, or, from 7 days before or after the date of my request.

** I’m simply requesting an electronic copy of an electronic record, if one exists. I’m NOT asking for the opportunity to come in person to "inspect", nor to obtain a printed copy of, this electronic record. I’m requesting explicitly that any responsive info be provided to me via the electronic medium / electronic format (in which the copy of this record already exists). If you are unable to fulfill any or all parts of this request, please specifically cite where a reason for denial is justified under NC Public Records Law. **

    Thank you for your patience.

     

    We understand that the exemption you cited exists, and we’re familiar with § 132‑1.7.(a)(4). However, we think it’s unlikely that section (or other parts of the public records law) makes GPS data in general not a public record.

     

    Although some of the reports might contain confidential information, we’re not asking for any of that. What we are asking is that you please retrieve the records we’ve requested, review them for any individual records you feel fall under the exemption you’ve cited, remove any co-mingled confidential information, redact them etc, and then please produce only the records that are left and are public.

     

    I will follow up again in 1 week, if I don’t hear anything else before then.
