Good evening Chad, Kim, Janina, Bryan, Jody, (Records Officer / Custodian(s) of these Records),

Please reply promptly to the following public records request, which I’m making in accordance with NC Public Records Law. https://www.ncleg.net/enactedlegislation/statutes/html/bychapter/chapter_132.html

The request specifically seeks records held by the North Carolina State Bureau of Investigation [NC SBI], relating to the following SBI personnel:

1) J. A. Alderman – Special Agent

2) J. D. Bare – Special Agent

Please provide the electronic copy of the following records for each individual:

A. Complete employment history with the NC SBI, including date of hire, position history, and current employment status.

B. The Oath of Office executed upon entering public service, including any renewals or subsequent oaths taken during employment.

C. Documentation of any official bond, fidelity bond, or surety bond required as a condition of holding the office of Special Agent, including:

- Bond number
- Bonding company
- Coverage amount
- Effective dates
- Copies of the bond instrument

D. Records identifying the statutory authority requiring the oath and bond for the position held.

E. The name and contact information for the “Custodian of Records” responsible for maintaining these documents, if they are maintained outside of the SBI.

** I’m simply requesting electronic copies of electronic records, if they exist. I’m NOT asking for the opportunity to come in person to “inspect”, nor to obtain a printed copy of, these electronic records. I’m requesting explicitly that any responsive info be provided to me via the electronic medium / electronic format (in which the copies of these records already exist).     Your letter cites a human resources statute, and that you have “no other public records” that are responsive to my request, besides the salary and employment history provided.

     

    I’d just like you to confirm explicitly whether you do actually have access to those records, and just will not be providing them. Or, if you’re saying there are literally no responsive records. Many entities have provided me with Oaths of Office and other records as requested.

    I’m not sure why it was returned to you recently. But I’m guessing perhaps that your letter required a signature. In which case, unfortunately our post office returns letters and packages, almost instantly. This is a recurring issue.

    However, I can see from the stamp on the envelope, as well as the content of the letter (May 07), that you did not mail me this letter until after the start of May.

     

    I submitted my records request on March 19th. On April 7th, Chad Flowers stated the records were mailed to my PO Box the week prior.

    – There was never a need to mail me physical copies to my PO Box. An emailed response is satisfactory, and is what was requested. I simply provided a mailing address as a courtesy.

     

    In any case. I checked my PO Box on April 11th. There was no package / flashdrive / letter / missed mail notice, etc.

    – I followed up with Chad about this on April 11th, and again on April 23rd. I did not receive a response.

     

    I checked my PO Box again on April 27th.

    – There was no package / flashdrive / letter / missed mail notice, etc.

    – On May 01, I notified your organization that the request was being marked as “Denied”.

     

    It is clear to me that you did not actually mail the files as Chad indicated back on “the week prior to” April 7th. Instead, only after I’d marked the request as “Denied” by your organization on May 01, you then attempted to send me a letter at that point. Since I was not expecting a delivery to my PO Box, and do not frequently check the box unless I’m expecting something — that is likely why it was returned.

     

    Since you have sent me photos of the letter you mailed, I will consider that as your having providing me with the records requested. However, it is unclear why it has taken 2 months to compile records that should have easily been sent via email within one day or one week.

     

    I will now mark this request as “Completed”

    Under NC Public Records Law, your office is required to “promptly” process all public records requests. Essentially, this means that if you intentionally delay the fulfillment of a request by allowing it to “sit” until staff has availability to address it, or feels like answering my emails, then this could be considered a denial of a request. With this in mind, I want to highlight again the court case referenced in item #6 of the following article, posted on the NC Press Association website.     Having received no response since submitting the request on March 19th, I would not be expecting any records to be sent to my PO Box.

     

    Additionally. I do not regularly check that box, unless I’m expecting a delivery. I do not receive a notification whenever a package is on its way / delivered, and the USPS regularly returns packages from my PO Box that aren’t picked up within 1 day of delivery.

    The request specifically seeks records held by the North Carolina State Bureau of Investigation [NC SBI], relating to the following SBI personnel:

     

    1) J. A. Alderman – Special Agent
    2) J. D. Bare – Special Agent

     

    Please provide the electronic copy of the following records for each individual:

     

    A. Complete employment history with the NC SBI, including date of hire, position history, and current employment status.

     

    B. The Oath of Office executed upon entering public service, including any renewals or subsequent oaths taken during employment.

     

    C. Documentation of any official bond, fidelity bond, or surety bond required as a condition of holding the office of Special Agent, including:

     

    – Bond number
    – Bonding company
    – Coverage amount
    – Effective dates
    – Copies of the bond instrument

     

    D. Records identifying the statutory authority requiring the oath and bond for the position held.

     

    E. The name and contact information for the “Custodian of Records” responsible for maintaining these documents, if they are maintained outside of the SBI.
