To clarify, Sheriff Hawkins did a search and found no responsive records. In an effort to ensure complete transparency and ensure the accuracy of that response, he asked that our County Attorney’s Office coordinate with IT to conduct its own manual search, which is what is still ongoing.

I don’t understand your response. On several occasions, you indicated to me that you were either working to obtain records, or had been reviewing them. You’ve now determined there are “no responsive records” that exist. However, you’re also saying that you’re “currently” conducting ongoing “additional review” to “reveal responsive records” ? That statement does not suggest to me that there are definitely “no responsive records”. I do not consider this aspect of the request to be completed.
Please let me know as soon as you determine if there are responsive emails and text messages. As the custodian of those records, Mr. Hawkins (who has been CCed on this thread), surely can clarify that answer and he is also able to produce the requested records himself, if needed.

This has been a cumbersome process on our end, in part because the county has a separate email server for some of our public safety agencies which is maintained in partnership with the City of Gastonia’s IT staff. We’ve made progress on securing the records despite a number of technological barriers but are still in the process of reviewing these. We do not have an estimated timeframe for the completion of this request, other to say that we are continuing to actively work on processing and reviewing what has been asked for.

I submitted the following request to the County on May 08:

I understand you might have other requests to process besides mine. However, it has been 3.50 months since my request was submitted, and I’ve asked several times that you please provide some idea of timing or an anticipated date for the completion of my request. I followed up about this again on July 25th, and did not hear back.
Under NC Public Records Law, the County is required to “promptly” process all public records requests. Essentially, this means that if you intentionally delay the fulfillment of a request by allowing it to “sit” until staff has availability to address it, or feels like answering my emails, then this could be considered a denial of a request. With this in mind, I want to highlight the court case referenced in item #6 of the following article, posted on the NC Press Association website. In this instance: “The trial court held that an unjustified one-month delay in production of records was tantamount to a denial”. http://www.ncpress.com/

In the email thread above Gaston County Police Dept. ([email protected]) also replied to me, saying I “… will need to contact Supervisor C Rollins at 704 866 3320” .
It’s unclear why I’d be required to complete an additional step of calling a phone number in order to submit a public records records request. I’ve now CCed you on this email, and that should be sufficient. My request has been submitted to the appropriate entity(ies) and records officers for the County / Sheriff / Police, using the available contact information on the internet.
Additionally, Captain Waldrop is one of the actual custodians of the records pertaining to his own email / text messages, and by submitting my request to him directly, the County is obligated to fulfill the request by Law.
Please proceed to fulfill my request.
