Good afternoon Records Officer / Custodian(s) of these Records,
Please reply promptly to the following public records request, which I’m making in accordance with Virginia Public Records Law / FOIA Laws. The type of basic salary data I’m requesting is simple to provide, commonly produced, and widely considered a matter of public record as part of the public personnel file of employees. Many entities fulfill requests like this via email in 1 week, and in many cases 1 day.
Please provide the names and salaries of all current City of Danville, VA employees as of the present day [on the date the query is performed]. I consider the term “employee” to apply to any full or part time employees, staff, board or council member, commissioner, manager, elected official, etc. Please include the following:
A. First / Last name
B. Position / title / department
C. Date of hire
D. Salary [include hourly wage, hourly rate, or annual salary -- whichever payment structure is applicable to the employee]
Ideally, I’d like to receive this info in an Excel or other machine-readable format.

I’m NOT asking for the opportunity to come in person to “inspect”, nor to obtain a printed copy of, this electronic record. Record request #26-573 has been closed. The closure reason supplied was:
The City acknowledges your position that the post office box address you provided constitutes your legal address.
However, the issue before the City is not whether the address provided may be used for mailing purposes. Rather, the City must determine whether sufficient information has been provided to establish eligibility to exercise rights under the Virginia Freedom of Information Act.
Pursuant to Virginia Code § 2.2-3704(A), the City requires requesters to provide sufficient information to establish eligibility under the Act. The information provided with your request, including the North Carolina post office box address, is insufficient for the City to determine that eligibility has been established.
Because eligibility under Virginia Code § 2.2-3704(A) has not been established, the City declines to process your request at this time.
Should you choose to submit information sufficient to establish eligibility under Virginia FOIA, the City will review any future request in accordance with the Act.

Section 2.2-3704(A) states:
“Except as otherwise specifically provided by law, all public records shall be open to citizens of the Commonwealth, representatives of newspapers and magazines with circulation in the Commonwealth, and representatives of radio and television stations broadcasting in or into the Commonwealth during the regular office hours of the custodian of such records. Access to such records shall be provided by the custodian in accordance with this chapter by inspection or by providing copies of the requested records, at the option of the requester. The custodian may require the requester to provide his name and legal address.”
The word “may” means it is permissive, not mandatory. The custodian has the option to ask for a name and address, but you are not “required” to do so. Most importantly, the law does not allow the custodian to deny a request simply because a requester refuses to provide that information — you’re making a request to me for identification, and it not a “condition” of access.
