(November 2019) Request for info related to penalties / charges for “shooting dogs” in Buncombe County, NC

Hello Buncombe County, NC District Attorney’s Office,

I’d like to make a public records request for the following information. This request should contain the most responsive information as of 11/16/19:

1. What / if any are the penalties in the State of NC for a person who shoots a dog that comes onto their own property?
2. Does Buncombe County have a dog ordinance?
3. Is it a felony in Buncombe County to shoot someone else's dog if it comes onto your property?
4. What / if any crimes are committed if someone shoots another person’s dog on their own property?

    The Clerk of Superior Court does not determine penalties for acts whether civil or criminal, But, Buncombe County does have an animal ordinance that can be obtained through a google search. It is Chapter 6 “Animals” of the Buncombe County Code of Ordinances.

     

    North Carolina has statutes dealing with dogs (Chapter 67 of the General Statutes) and Cruelty to animals (Chapter 19A). Dogs are property so there can be a criminal charge for destruction of property. It will always depend on the circumstance.
