(November 2019) Request related to Buncombe County Fire Marshall’s office and inspections as of 11/30/19

Hello Buncombe County, NC Government,

I’d like to make a public records request for the following information. I'd like to know:

1. Does the Buncombe County Fire Marshall’s Office inspect all buildings in the County that are open to the public?
2. What do they inspect for?
3. Do they inspect for fire alarms, exit lights and handicap entrances?
4. Do they inspect for overcrowding in building for functions?
5. How often are buildings inspected that hold public functions?
6. What are the fines if a company does not enforce the Fire Marshall rules for overcrowding?

This request should include all responsive information from 11/01/19 - 11/30/19.

    Hello Sunshine, thank you for checking in. After a review of this request, these appear to be general questions rather than a request for records. The County does not possess a record that answers each of these questions however I can provide some information from our Fire Marshal.

     

    The Fire Marshal’s Office is responsible for the enforcement of the fire code and minimum housing code for Buncombe County.

     

    Additionally, the Fire Marshal’s office makes regular inspections of businesses, investigates fires, and conducts fire prevention programs throughout the year on an as-requested basis.

    I’d like to make a public records request for the following information. I’d like to know:

     

    1. Does the Buncombe County Fire Marshall’s Office inspect all buildings in the County that are open to the public?

     

    The Fire Marshal’s Office inspects all commercial buildings by Fire District on an even/odd-year schedule. Buncombe county has 20 fire districts so even number districts are inspected one year and odd number districts the following year. This puts most businesses on a two-year cycle however, there are certain businesses and building the State requires annual inspections for.
    2. What do they inspect for? Inspections are done in accordance with the Buncombe County Fire Prevention Ordinance and North Carolina State Fire Code which can be found at the office of the NC State Fire Marshal.
    3. Do they inspect for fire alarms, exit lights and handicap entrances?

     

    Yes, and more, see above.
    4. Do they inspect for overcrowding in building for functions? The Buncombe County Fire Marshal’s Office inspects for overcrowding if they have received a complaint or are requested to do crowd control for an event.
    5. How often are buildings inspected that hold public functions? See question 1.
    6. What are the fines if a company does not enforce the Fire Marshall rules for overcrowding? Fines vary depending on the violation. If this requestor has questions about a particular location or event they can reach out to the Fire Marshal’s office at 828-250-6620.
