(November 2022) Request for Buncombe County, NC District Attorney: Communications between NC Attorney General’s Office. Related to “transfer of pending Buncombe County Murder Cases”. 06/01/22 – 11/09/22.

Good afternoon Buncombe County, NC District Attorney’s Office (Records Officer),

I'd like to make a public records request for the following information under NC Public Records Law.

Please provide all correspondence [emails, SMS texts, Google Chat messages, Facebook Messenger] from June 01, 2022 through November 09, 2022, sent between the Buncombe County District Attorney and the NC Attorney General's Office. Specifically related to the transfer of pending Buncombe County Murder Cases.

** Please DO NOT include case numbers, names, or any other personally identifiable information about cases. Sunshine Request will not publish this type of info on their site.**

I am not requesting to come in person to inspect, nor to obtain printed copies of, electronic records. In accordance with NC Public Records Law, I’m requesting explicitly that all responsive records be provided via an electronic medium / format (in which the records should already exist), such as an email, file share, google drive folder, mailed flash drive if necessary, etc.

I do not have any additional or further clarifying info to provide other than what you see in the message above. If you are unable to fulfill any or all parts of this request, please specifically cite where a reason for denial is justified under NC Public Records Law.

    Thank you for your reply.

     

    We have previously been advised to send various public records requests related to the District Attorney’s Office, to you and Todd Williams. Although, I do acknowledge that your role is as “Clerk of Superior Court”.

     

    Since the communications being requested are related to correspondences To and From the DA’s office, I would expect the DA’s office holds and maintains those records as you’ve said.

    As you can see, you were also CCed on the email above where we made our records request to you directly. Kindly respond and let me know if / when the request will begin being processed and when you anticipate completion.

    It would seem to me that either the D.A. or the Attorney General’s office would be appropriate.
