(October 2022) Request for City of Asheville, NC: Communications between Chief of Police, City Manager, City Council. Related to Merrimon Ave traffic. 01/01/22 – 10/16/22

Hello City of Asheville, NC Government (Records Officer),

I'd like to make a public records request for the following information under NC Public Records Law.

Please provide ALL communications [emails, SMS texts, Google Chat messages, Facebook Messenger] sent to, sent from, and sent between any and all of the following: the AVL Chief of Police, the AVL City Manager, and AVL City Council Member(s). Specifically related to recommendations regarding safety concerns, and other info [unspecified] related to Merrimon Avenue traffic reimagining. During the specific time period of January 01, 2022 through October 16, 2022.

To clarify -- I am only seeking communications sent between the three parties listed above (Chief of Police, City Manager, any member of City Council).

I am not requesting to come in person to inspect, nor to obtain printed copies of, electronic records. In accordance with NC Public Records Law, I’m requesting explicitly that all responsive records be provided via an electronic medium / format (in which the records should already exist), such as an email, file share, google drive folder, mailed flash drive if necessary, etc.

    Good morning, Sunshine Request,

     

    I received your messages inquiring about the status of your requests that are in the City of Asheville Email Search Queue, and I wanted to let you know what’s going on.

     

    As you know, public records requests for emails are processed in the order received, as we have found that to be the most fair and equitable way to fulfill these requests. However there are rare occurrences in which I am tasked with pulling emails for separate matters outside of public records requests, such as judicially mandated litigation matters. In these cases, there is no flexibility over the deadlines given by the Court and these pulls therefore have to take priority. That is what has happened here; I am currently working on an email pull for a litigation matter in which there is no leeway with the given deadline. As soon as I have this completed, the email pulls for public records requests will resume. I appreciate your patience and understanding.
