(October 2025) Request for Cabarrus County, NC Government: Board of Commissioners closed session meeting minutes and recordings 01/01/2023 – 06/31/2023.

Good afternoon Ariadne, Lundee, Kelly, Jeff, Jonathan, Records Officer / Custodian(s) of these Records,

I attempted to login to my JustFoia account on your site in order to submit this request. However, my password is not being accepted. I tried the “forgot password” button to send a reset to my email address, 3 times. I have not received anything from your automated system, so there is no way for me to reset the password or login. There is nothing in my spam folder either.

I cannot submit the request to you in your preferred format. Therefore, I’m submitting it to you all directly, as you are the primary custodian(s) of these records, and by Law should now proceed to fulfill the request.

Please provide the electronic copy of all “meeting minutes”, “audio” or “video” recordings, for all Closed Session meetings of the Board of Commissioners during the time period of January 01, 2023 through June 31, 2023. Specifically – any of those minutes and recordings related to the purchase of the ACN Building.

Under NCGS 143-318.10(e), "... minutes or an account of a closed session conducted in compliance with G.S. 143-318.11 may be withheld from public inspection so long as public inspection would frustrate the purpose of a closed session." The purpose of these closed session discussions can no longer be “frustrated” since the purchase has since been completed.

** I’m simply requesting an electronic copy of an electronic record, if one exists. I’m NOT asking for the opportunity to come in person to “inspect”, nor to obtain a printed copy of, this electronic record. I’m requesting explicitly that any responsive info be provided to me via the electronic medium / electronic format (in which the copy of this record already exists). If you are unable to fulfill any or all parts of this request, please specifically cite where a reason for denial is justified under NC Public Records Law. **

    Thank you for the update. As to the minutes, Cabarrus County does not prepare written minutes of closed sessions. The recordings constitute the minutes for closed sessions.

    As I mentioned on 10/01. I initially attempted to login to my JustFoia account on your website in order to submit my request. My password was not accepted (even though it’s correct), so I tried the “forgot password” button to send a reset to my email address ([email protected]). I tried this reset process 3 times, and I did not receive anything from your automated system. I checked my spam folder as well, and there was nothing there either.

     

    Currently, there is still no way for me to reset my password or to login to my account. I need to be able to login to review this, and all past / future, requests that I send.

    I’m just following up to check the status of the request above. Are you able to provide an anticipated date or timeline for the completion of my request?

     

    Additionally – I’d like to ask that you please relay the following information to the JustFoia provider, or your IT Department:

     

    Although the JustFoia platform has a “sign in” feature for users with accounts, there is no way to actually create or register an account. I have looked all over the page, and I cannot find any way to set up an account.

     

    I understand that for the purposes of sending this particular request, you manually entered my request into the platform. However, there is not a way for me to sign up or even create my own account. I know this is an error, as many other entities use this same platform, and I know it should be possible to create a user login to send requests.

    I understand JustFoia is saying that I don’t have an account. I’m not sure why that may be… I’m pretty sure I’ve used your platform to submit requests and login in the past.

     

    In any case. I will attempt later this week to “re-register” my account.

     

    I also understand I don’t need to create an account in order to submit a request to Cabarrus County. However, I personally would like to be able to sign into an account to review records requests I submit now and in the future.

    I’ve CCed Todd / I.T. so that I may hopefully receive help with the following issue:

     

    As I mentioned on 10/01. I initially attempted to login to my JustFoia account on your website in order to submit my request. My password was not accepted (even though it’s correct), so I tried the “forgot password” button to send a reset to my email address ([email protected]). I tried this reset process 3 times, and I did not receive anything from your automated system. I checked my spam folder as well, and there was nothing there either.

     

    Currently, there is still no way for me to reset my password or to login to my account. I need to be able to login to review this, and all past / future, requests that I send.

     

    Please advise.

    Under NCGS 143-318.10(e), “… minutes or an account of a closed session conducted in compliance with G.S. 143-318.11 may be withheld from public inspection so long as public inspection would frustrate the purpose of a closed session.”  The purpose of these closed session discussions can no longer be “frustrated” since the purchase has since been completed.
