Please reply promptly to the following public records request, which I’m making in accordance with NC Public Records Law.

Please provide the electronic copy of all “Mileage Logs” for Onslow County, NC District Attorney Ernest (Ernie) Lee, as required in the Motor Fleet Management Manual effective July 2025. Specifically – logs during the period of July 01, 2025 through October 28, 2025.

I am explicitly asking that you do not provide me with personally identifying information about victims or defendants and their addresses, names, case numbers etc. (if that type of info happens to be contained in the responsive records).

The applicable section of the Motor Fleet Management Manual is below for your reference:

III. Official Use
Acceptable/Prohibited Use
State-owned vehicles may only be driven by state employees and only used for official
state business except when allowed by a specific exception in state law, rule, or policy.
It is unlawful to use a state-owned vehicle for a private purpose according to NCGS
§ 14-247. This statute does permit driving a state-owned vehicle between one’s duty
station and one’s home when approved by MFM for commuting purposes under
NCGS143-341(8)i,7a.
Mileage logs must be kept for every state-owned vehicle, including both agency-
owned and MFM-owned vehicles. At a minimum, the log must include the date of each
trip, the name of the driver, the purpose of the trip, and the miles driven. These logs are
subject to compliance review by MFM and may also be subject to audits.

    I submitted the following public records request to your offices via email on October 30, 2025:

    I have not received your response to my initial request, nor to my follow up emails about this on January 08, 22, or 29.

     

    Under NC Public Records Law, your office is required to “promptly” process all public records requests. Essentially, this means that if you intentionally delay the fulfillment of a request by allowing it to “sit” until staff has availability to address it, or feels like answering my emails, then this could be considered a denial of a request. With this in mind, I want to highlight the court case referenced in item #6 of the following article, posted on the NC Press Association website.     I have been attempting to get someone to process this valid public records request since first submitting it to your offices on October 30, 2025. To this point, I’ve received a lot of back-and-forth from NCAOC and NCDOA as to who may be responsible to fulfill this request.

     

    Having received no further assistance or clarification, I am now adding the Onslow Clerk of Court, and Ernie Lee, back onto this communication. As I understand it, you are the primary custodian of these records and by Law are obligated to process this request. You were also CCed when the request was first submitted in October.     I first submitted this request on October 30. I have not received any responsive records from any entity to this point.

     

    I am confused by your recent email. The last time I received any response from you (November 07) you indicated that:

     

    “NCDOA would be the custodian of existing records of mileage logs. The response from the Administrative Office of the Courts establishes that they would not be the holder of these records.
    We have received your request and are processing it at this time.”

     

    For the past month, I’ve been following up on this, thinking you’ve been processing my request.

     

    Can you please explain who is the actual custodian of the records I’ve requested, and please process this request without further delay? If you’ll further delay or deny the production of these records, please cite specifically where it is justified by Law.

     

    I will follow up again in 1 week if I do not hear anything else.
