Hello Transylvania County, NC Schools,
I’d like to make a public records request for the following information:
1. Please provide all electronic communications to, from, or between, the Transylvania County Board of Education and Superintendent Jeff McDaris concerning the decisions regarding the graduation ceremonies for Brevard High School and Rosman High School from the period of March 30th, 2020 through May 7th, 2020.
2. Please include any electronic communications sent to, by, or from, Superintendent McDaris and other Central Administrative Staff at Transylvania County Schools concerning this topic, during the same time period.

11/16/22 Editor’s Note to Sender: We sincerely apologize for having just realized this request slipped through our follow-ups queue since July 2020!

(In our opinion — Now that time has passed, we suspect Transylvania County Schools may have additional knowledge about what is/is not required to be produced under NC Public Records Law … as well as how to fulfill requests for easily accessible information, without charging fees.)

We cannot commit to covering potential fees / costs related to any of the records processed through our site. Additionally, while we would typically be happy to receive the files via mail (if that’s what is necessary), our team is not going to the PO Box right now due to the COVID 19 pandemic.

It was necessary to print the documents prior to completing the necessary steps for redaction to protect the personally identifiable information of other students pursuant to the Family Education Rights Privacy Act 20 U.S.C. 1232g, 34 C.F.R. 99 et. seq. (“FERPA”), and confidential personnel information pursuant to N.C.G.S. 115C-319. Our electronic email technology does not give us the ability to edit within an already sent email document. Scanning each one of these into one document is time-consuming and labor-intensive. For this reason, the documents have been provided in “hard copy,” the final step of our process for these records. It will be unnecessary and additional work for us to scan the documents and complete the steps that you have indicated. The documents are available at our reception desk. If you would like us to mail them, please send a self-addressed mail, Fed-Ex, or UPS package capable of handling approximately 2.6 pounds.

We apologize for not catching this sooner –
We’d like to ask if you can please clarify in what format the responsive records will be delivered (flash drive, CD, hard copy)? The request asked for “any electronic communications”. As these are records already in a digital format, it is unclear if / why the files would need to be printed, if that is the case.
Additionally, we do not need physical copies of associated files for this request, nor is it required by law that we must come to your office in person to pick up records, if you are suggesting that’s the only way they can be provided.
We would greatly appreciate it if you could send a digital copy of the requested records – Under NC Public Records Law you should be able to provide these in a digital format such as Google Drive, Dropbox, email, pdf, CD / flash drive (if necessary), etc.
Is it possible that the files could be uploaded to something like a public Dropbox or Google Drive whenever they are ready? That would be great! If this isn’t possible, and mailing a CD or flashdrive is what is required, please let us know and we’ll be happy to provide a mailing address at that time.
