FHA Mortgage Insurance – Legal Authority, Capacity, and Beneficiary Designation

To Whom It May Concern,

Pursuant to the Freedom of Information Act, 5 U.S.C. § 552, this request seeks access to agency records sufficient to establish the legal framework governing the administration of FHA mortgage insurance and related federal credit protections.

Records Requested

This request seeks records created, issued, or in effect during the period:
January 1, 2000 through the date of this request
This includes any records that:
remain in effect,
have been superseded, or
have been archived but were operative at any time within this period.

Please provide records reflecting or establishing the following:
1. Beneficiary Identification
Records that define, describe, or otherwise identify the party or class of parties recognized as the beneficiary of FHA mortgage insurance or any associated federal credit guarantee, including but not limited to statutes, implementing regulations, HUD Handbook provisions, policy issuances, or formal legal opinions.
2. HUD Legal Capacity
Records that explain or interpret the legal role or capacity in which HUD functions when administering FHA mortgage insurance programs, including whether HUD operates in the capacity of an insurer, guarantor, governmental administrator, or other defined role, as reflected in policy memoranda, guidance, or legal analysis.
3. Existence of Fiduciary or Trust Relationships
Records discussing, analyzing, or addressing the existence or absence of any fiduciary, trust, or beneficiary relationship involving:
* HUD and FHA-insured borrowers; and/or
* HUD and FHA-approved or participating lenders.
This includes any internal or external legal interpretations, policy statements, or advisory opinions.
4. Authority for Insurance Premiums and Fees
Records identifying the legal authority relied upon for the imposition and collection of FHA mortgage insurance charges, including:
* Upfront Mortgage Insurance Premiums (UFMIP);
* Annual or periodic Mortgage Insurance Premiums (MIP); and
* Any additional fees associated with FHA single-family mortgage insurance programs.
Please include relevant statutory provisions, regulatory citations, and any interpretive guidance.
5. Oversight and Legal Interpretation Authority
Records identifying the office(s), division(s), or official(s) within HUD responsible for:
* Legal interpretation of FHA mortgage insurance authority; and
* Oversight of compliance with governing statutes and regulations.
This may include organizational charts, delegation orders, or internal directives.

Scope Clarification
This request is limited to policy-level, legal, and administrative records. It does not seek:
* Individual borrower or loan files
* Case-specific records
* Performance metrics or statistical program data
* General HUD policies unrelated to FHA mortgage insurance

As written, we find the request to be overly broad or unclear for any entity or our team to properly address / fulfill. Much of what’s being requested also seems like more of informational type questions for government entities to answer (or, info that may already be available online), rather than a clear request for a specific searchable record or data set.

Additionally, the written timeline in the request’s Message (“January 1, 2000 through the date of this request“) does not match the timeline indicated in the “Start Date / End Date” section of the request form (January 01, 2020 – March 26, 2026).

General Advice:

– It is important what you’re requesting is specific and reasonable. Please specify the exact records you’d like to receive, rather than any “possible” or “potential” info that could be searched.

– When requesting communication records, it’s important to specify the exact type of communications (such as emails, text messages, etc.) being requested, who the communications are “sent to”, “sent from”, or “sent between”, and any specific people / staff / departments etc. that should be included. It’s also important to include a specific date or time period, and any specific subject matter or specific keywords that should be included in the search.

– We recommend limiting communications requests to cover a three month time period, or shorter. Remember that the larger the request, the more time it takes to fulfill. If you’d like to request records over a larger time frame, then please include more keywords, to / from addresses etc. to limit the number of responsive records.

– Clarifying this info will help to greatly narrow the scope of the request, and will also reduce the amount of time it takes the Disclosing Agency (as well as our team) to process the request.

Once our request form reopens (it’s currently “hidden”), please feel free to revise and submit a new request to our website. Please clearly indicate any specific details, subject, message, dates, record types, City / County / State, etc. about the exact public records that are being requested.

☀️ Requests that are incomplete, non-specific, or vague.

While we do proofread requests we receive for general spelling and clarity, we may choose not to fulfill the request if it is incomplete, or it is unclear what specific information the requester hopes to receive. In this case, the sender may rewrite and resubmit the request.

It’s the requester’s responsibility to write the request in a manner that clearly specifies a record that is being requested, and to what government entity it should be sent.

☀️ Requests that are only informational questions, and requests that are not addressed to government entities.

Sunshine Request is a site built to make requests for public records to the government — Public records are recorded information such as documents, government emails, and data sets.

In the interest of preserving our team’s time to focus on the high volume of requests on our site, as well to respect the staff time of government entities fulfilling records requests, Sunshine Request will no longer fulfill “requests” that are just informational type questions for government entities to answer.

We also will not fulfill requests made to non-government entities.

It’s the requester’s responsibility to write the request in a manner that clearly specifies a record that is being requested, and to what government entity it should be sent.

Please specify the exact type of records you’d like to receive, rather than any “possible” or “potential” info that could be searched. Remember that the larger your request, the more time it usually takes to fulfill. Specificity will often help reduce the amount of time needed to process the request.

It is important that a request has a clearly written and complete Subject and Message, and also specifies the Government Entity (or entities), City and/or County, and State to which the request should be sent. If applicable, please also include any responsive timelines for the info that should be requested.

While we do proofread requests we receive for general spelling and clarity, we may choose not to fulfill the request if it is incomplete, or it is unclear what specific info the requester hopes to receive, or if it violates our policies.
