Editor’s Note: Sunshine Request makes no claim as to the veracity of any statements or information contained in any of the requests, or public records, we receive.

Editor’s Note 04/05/21: The submission above has been revised for clarity. As originally written, this is not actionable request for public records that we will fulfill.

Additionally – It is unclear what specific “documents” the sender hopes to receive (whether that’s emails between certain parties, texts, receipts, any other specific forms of “documentation” etc) and during what specific time period. We will interpret on the senders’s behalf that they would like to receive “a list” or “spreadsheet” of “any restitution paid as of 04/05/21.”

If the sender ever wishes to submit a separate request for other information via our website, they are welcome to do so.

The request we send to AVL City Gov will read as follows:

Subject: (April 2021) Request for Asheville, NC Police Department (APD) – Any payments of restitution related to Damaged Medic Tent Supplies in June 2020

Message:

Hi City of Asheville, NC Government (and APD),

I’d like to make a public records request for the following information:

Please provide a list or spreadsheet of any/all restitution paid by the City of Asheville or the Asheville Police Department (APD) related to the destruction of the medical tent supplies during the June 2020 protests.

Please include the amount paid in restitution, month and year of payment, and a description of the property destroyed. Please provide all responsive records as of 04/05/21 (or on the date the query is performed).

** Please do not include names of individuals, case numbers, or any other personally identifying information. Sunshine Request will not publish those types of records on their site.

Thank you for your assistance!

Sunshine Request will not fulfill the following types of requests:

☀️Requests for public safety information specific to a single individual, address, incident or name.

This includes police reports, calls for service, complaints / incident reports / citations, criminal / arrest type records, or camera footage. We will, on a case by case basis, fulfill public safety related requests that focus on system-level trends and data. Due to the personal nature of this type of information, we recommend that the sender reach out directly to the appropriate entity for assistance with the request.

☀️ Requests that are incomplete, non-specific, or vague.

☀️ Please be specific:

It is important that what you are requesting is specific and reasonable, and is an actionable records request. Please specify the exact records you’d like to receive, rather than any “possible” or “potential” info that could be searched. Remember that the larger your request, the more time it usually takes to fulfill. Specificity will often help reduce the amount of time needed to process the request.

It is important that a request has a clearly written and complete Subject and Message, and also specifies the Government Entity (or entities), City and/or County, and State to which the request should be sent. If applicable, please also include any responsive timelines for the info that should be requested.

Before submitting a request, please take a moment to review our tips for How to write and make a successful request. If you have additional questions about our site or how to make requests, please check out our FAQs or Policies page.

    Good morning Sunshine Request,
An inventory of the property can be found on pages 215-217 of the After Action Report and the agreed upon amount for restitution is $2,156.88 as outlined on page 19 of the After Action Report. However, APD has not been able to reach the contact to deliver the check despite repeated attempts, therefore no payment has been made and there are no responsive records. The contact is welcome to reach out to Deputy Chief James Baumstark to arrange this payment at any time. Let me know if you have any questions.
    Best,
