Hello City of Asheville, NC Government (and APD),

I’d like to make public records request for the following information:

Please provide any contract(s) that the Asheville Police Department (APD) has entered into with any outside company, (vendor / vendors), for the management of secondary employment opportunities for its police officers.

This request should also include all of the following:

1. Name of the Vendor

2. Compensation formula for the Vendor to manage the secondary employment

3. Name and rank of the person within Asheville Police Department (APD) who is the point of contact/coordinator for the Vendor

4. Any compensation that is provided by the Vendor to the person within Asheville Police assigned as the coordinator

5. A list of all locations requesting officers and what type of service being requested.

6. A list of all compensation rates for the officers for each location

7. A list of all officers participating in the secondary employment program regardless of their rank

8. Whether all opportunities for secondary are open to all officers

9. If certain secondary opportunities are restricted to certain officers, the criteria for selecting those officers and who makes that decision.

    The records and information responsive to your request can be found below.

     

    Since beginning to use a vendor for our secondary employment, APD has updated Policy: 2002 – Secondary Employment, which I’ve attached here.

     

    1. Name of the Vendor – OFF Duty Management

     

    2. Compensation formula for the Vendor to manage the secondary employment – The City does not pay for the service. The cost of the service is passed to the requester by OFF Duty Management. This cost is passed to the requester by OFF Duty Management

     

    3. Name and rank of the person within Asheville Police Department (APD) who is the point of contact/coordinator for the Vendor – Section 2002.3 of the Asheville Police Department’s Secondary Employment Policy states “The Patrol Executive Officer is the designated point of coordination for department extra-duty assignments, including acting as the primary department liaison with the department’s contracted extra-duty provider on behalf of the department.”

     

    4. Any compensation that is provided by the Vendor to the person within Asheville Police assigned as the coordinator – No additional compensation.

     

    5. A list of all locations requesting officers and what type of service being requested. – OFF Duty Management is the owner and manager of this list.

     

    6. A list of all compensation rates for the officers for each location
    $45 per hour base rate
    $55 if scheduled within 24 hours
    Holidays $67.50

     

    7. A list of all officers participating in the secondary employment program regardless of their rank – A list of these officers is attached.

     

    8. Whether all opportunities for secondary are open to all officers – In keeping with the best practices recommended by OFF Duty Management, all secondary employment opportunities except Asheville City Schools and faith-based organizations, are open to all officers who have signed up.

     

    9. If certain secondary opportunities are restricted to certain officers, the criteria for selecting those officers and who makes that decision. – For secondary opportunities at Asheville City Schools, those are first offered to the School Resource Officers. If spots are still unavailable, the opportunity is opened to all officers who are participating in the secondary employment program.

     

    Faith-based organizations are first opened to officers who have been consistently working on those employment opportunities. If spots are still unavailable, the opportunity is opened to all officers who are participating in the secondary employment program.

     

    Both of these are based on best practices recommended by OFF Duty Management. We are currently in a 6-month evaluation period with the new program to determine if any adjustments need to be made.
