[See Editor’s Note](August 2021) Submission related to “APD ERT” emails 01/01/21 – 07/22/21

Original Subject:
APD ERT

Original Message:
Hi City of Asheville, NC Government (Records Officer),

I’d like to make a public records request for the following information under NC Public Records Law:

Please provide all emails during the specific time period of January 01, 2021 through July 22, 2021 sent to and sent from, the City of Asheville Police Department's Chief Zack, Deputy Chief Baumstark, Deputy Chief Yelton, and any other command staff member specifically pertaining to the status or reduction of APD's ERT team.
-----

For all requested items above, please provide all .pdfs, files, attachments, videos, hyperlinks, etc. that are indicated within the responsive records. For example: A .pdf that is an attachment within an email, should also be provided as a document along with the responsive emails.

Please include all of those additional documents where applicable, as relates to the requested information above.
If the records are ultimately too large to send via emailed file share, I'd ask that you please create a public Google Drive folder / link or some other file format to transfer the files electronically.

Thank you for your assistance

Government Entity:
City of Asheville

Start Date / End Date:
January 01, 2021 - July 22, 2021

Editor’s Note 08/11/21: We apologize for the delay in processing and publishing this request on our site. Sunshine Request is a project built and run by a small team at PRC Applications. We run the site in addition to our primary business. While we will always do our best to process and follow up on requests as quickly as possible, there may be occasional delays, depending on our availability in a given week or month.

** The above submission has been marked as “Completed”, as it is very similar to a June 2021 request (currently open and being processed on our site), that asked for:

“… all emails during the specific time period of January 01, 2021 throughMay 24, 2021 sent to and sent from, the City of Asheville Police Department’s Deputy Chief Baumstark, Captain Stepp, Lieutenant Brown, and Stephanie Craig. Specifically, I am requesting all emails pertaining to the subject matter or referencing ERT.”

Although the new submission above is slightly different (longer timeline / different names specified), it also overlaps much of the same information that has already been requested in June — For that reason we’d ask that the sender please wait to resubmit a new request until the June request has been completed. Just so that there is no confusion or duplication of efforts by either the City of AVL or our team at Sunshine caused by sending in such similar requests.

Please keep track of the status of the original request at the following URL: https://www.sunshinerequest.com/records_request/june-2021-request-for-city-of-asheville-nc-police-department-emails-related-to-ert-01-01-21-05-24-21/

Per our last update to Liz Harper on July 02, 2021, we will follow up on that request again in “early October”.

If the new submission above is time sensitive, we’d recommend that the sender reach out to the City directly for help processing a new request sent outside of our website.

Additional Note for Users: Sunshine Request does not control if / when Government entities will confirm receipt, begin processing, complete, or deny requests we submit to them via our website. If you would like to make a request that is time sensitive, we recommend that you reach out to the appropriate government entity directly for assistance with a request, rather than submitting through our site.

Sunshine Request is run by a very small team. We do our best to review and send in requests to the appropriate entities as quickly as we are able, and it is up to the Government agency to determine the timeline and speed with which the request can be processed. We generally try to follow up on requests once every 1 – 2 weeks as we’re able, until the government agency has confirmed that the request has been received and is being processed (and there is some timeline for completion), and we will wait to follow up again during the time period they specify.

Please do not send us additional submissions asking that we “follow up on” a request on our site, or to ask for a status update on a request. If at any time you would like to track the status of your request, please “Search” for your request via the “Search box”, or by viewing the list of requests on the View All Requests page. Any updates we receive will be posted on our site as soon as we are able.

We are a small team — due to holidays, unforeseen events / scheduling conflicts, there may be times that we cannot publish or update requests for several days. We will do our best to process all requests as quickly as possible.
