Hi Transylvania County, NC Government (Records Officer),

I'd like to make a multi-part public records request for the following information under NC Public Records Law:

1a. Please provide a list of all current Transylvania County Magistrates as of 05/12/21 (or on the date the query is performed).

1b. I'm interested to know the number of years in service, so please include each Magistrate's employment start date as well.

2. Please provide all current Magistrate's resumes. This would include education, previous work history, job qualifications, as well as any other qualifications presented at the time they began discussing employment with Transylvania County Gov. To be clear - I'm not interested in whether they were simply "appointed into the position" as their sole qualification. Rather, I'm looking for any additional info / resumes provided which show qualifications to hold the position.

Additionally, although the North Carolina Administrative Office of the Courts cannot provide information from an employee’s personnel file, G.S. 7A-171.2 does provide statutory qualifications for a magistrate to be appointed and/or reappointed.

    Good morning,

     

    We are in receipt of your inquiry. The North Carolina Administrative Office of the Courts is in possession of documents that are responsive to your request. However, please note that of the information you requested, we are only able to provide the name and employment start date for the current magistrates in Transylvania County. Pursuant to G.S. 126-22, “personnel files of State employees shall not be subject to inspection and examination as authorized by G.S. 132-6.” As such, we are unable to provide you information regarding a State employee’s education, previous work history, or “job qualifications.”

     

    However, G.S. 126-23 does require state agencies to maintain and make available to the public certain, limited information regarding their employees, including name and “date of original employment.” We can pull this information from our HR system and provide it to you. I will contact our HR department and ask them to begin gathering this information, and I will send to you as soon as it is ready.

     

    In the meantime, you can access a list of judicial branch employees in Transylvania county, listed by name and job title at: https://www.nccourts.gov/judicial-directory. You can narrow results to Transylvania County by using the County drop down menu and narrow results to job titles containing “Magistrate” using the “Contains” search bar.

    I am receipt of your request. You will need to visit our website at www.nccourts.gov. At the top of the page choose “Services” then select “Public Record”. You will then scroll down to the bottom of the page and select “Public Records Request Form”. Please fill out the request and hit submit.     Magistrates are not employees of Transylvania County government. They are employees of the State of North Carolina, Administrative Office of the Courts. Therefore, Transylvania County does not have any of the records requested.
