Hi City of Asheville, NC Government (and APD),

I'd like to make a public records request for the following information. Please provide the most responsive records related to APD as of 09/14/2020:

1. Please provide all current employee names, salaries, positions and titles, including, Civilian, Narcotics. I will assume that certain employees will need to be redacted due to their position. Please include the following:

A - Name, Rank, and Salary as of 9/14/2020.

B - Current command structure within the agency.

For example:
John Doe - Captain Patrol/
Jane Doe - Captain Criminal Investigations, Jim Doe - Executive Lt / patrol/Criminal

2. I would also like to request the number of Officers who have retired or resigned between 01/01/2020, and 9/14/2020.

3. Please provide the number of positions that are currently open within APD as of 09/14/2020.

Editor’s Note 09/16/20: Related to Item #2 (“I would also like to request the number of Officers who have retired or resigned between 01/01/2020, and 9/14/2020.”)

Please note – In August 2020, we fulfilled a very similar request for the same info, specifically asking for “resignations” at APD from 08/01/19 – 08/31/20 (found here):

“… data regarding “APD resignations” by month, from August 01, 2019 – August 31, 2020. Specifically, I’m only interested in the numbers and reasons given for the resignations.

For Example: “Total of 3 resignations in July 2020 – 1 resignation for better job elsewhere; 1 resignation due to family issues; 1 resignation due to low morale.”

The response we received from AVL Gov in that case was as follows:

“Pursuant to N.C.G.S. §§160A-168(b) and (c), resignation information is confidential personnel record. Therefore, the city has no records responsive to your request.


We anticipate we will receive the same response related to Item #2 (“resignations”) in the new request above. However, we’re not sure if the same response also applies to “retirements” as well. Therefore, the request we send in will read as follows:

2.  I would also like to request to know the number of Officers who have “retired” from 01/01/2020 – 09/14/2020.

In a previous request AVL Gov stated that ‘Pursuant to N.C.G.S. §§160A-168(b) and (c), resignation information is confidential personnel record. Therefore, the city has no records responsive to your request.’

I do not know if that response only applies to “resignations” specifically, or if it also applies to “retirements” as well. If so, please specify.”

    Hi Terry,

     

    I believe the file you sent over in your previous email was intended to address the portion of the request which asked for: “2. I would also like to request the number of Officers who have retired or resigned between 01/01/2020, and 9/14/2020.”

     

    The document provided indicates that the results are as of 03/01/20, rather than 01/01/20 as requested. Can you please confirm whether there were also any responsive records starting back on 01/01/20, or, if 03/01/20 was the first applicable date that was located during your search?
