  I hope you’ve both been well, and that you had a good Holiday break.

   

  This is my third attempt to follow up with you regarding the following public records request. I submitted it on September 19:
  (September 2023) Request for Cleveland County, NC Schools: All current employees and salaries as of 09/19/23 or present day.

   

  I have not received a reply to my email dated November 29 @ 10:52AM. It was sent in response to an email Greg sent me earlier that same day.

   

  To reiterate:

   

  I think Greg was saying he has access to a list or a database of “employee hire dates” which includes the employee’s name (and/or their position, title, department) and their original hire date… but, this database does not include their salaries? Assuming that’s what he was saying, I have confirmed to you twice now that he should please send me the document. At a minimum, the document should include the employee’s Name and Hire Date.

   

  Having made all reasonable attempts to follow up, if I do not hear back in 1 week I will mark this request as having been “Denied” by your organization.

  Dear Sunshine Request,

   

  The requested information with employee names, positions, and wages is accurate as of the timeline in which you specified.

   

  I understand that your request asked for a list that also includes new hire dates. Unfortunately, we do not have a document that includes hire dates alongside the other requested information. As you know, the district is not required to create a document to fulfill a public records request, nor are we required to compile data into a form that does not already exist.

   

  However, if you would simply like a list of dates of hire, I can certainly look into whether we have such a list compiled.

  The type of basic salary data I requested (Name, Hire Date, Title, Salary) is very simple to provide, and is widely considered a matter of public record as part of the public personnel file of school employees. Many NC schools commonly fulfill requests like this via email in 1 week, and in many cases 1 day. You have also already provided this same type of salary data to me before.

   

  Under NC Public Records Law, CCS is required to “promptly” process all public records requests. I’m concerned that you may be intentionally delaying or ignoring the fulfillment of requests by allowing them to “sit” until staff has availability, or feels like addressing my messages. With this in mind, I want to highlight the court case referenced in item #6 of the following article, posted on the NC Press Association website.
