(April 2020) Request related to Asheville, NC Mayor’s eminent domain seizures as of 04/16/20

Hello City of Asheville, NC Government,

I’d like to make a public records request for the following information:

Please provide the addresses of all eminent domain seizures by the City of Asheville when Mayor Esther Manheimer was in office as Mayor and as a City Commissioner and for 5 years prior to when Mayor Manheimer was elected to City Council in 2009. This timeline should include 01/01/2004 - 04/16/2020.

Please provide the name / names of any law firm that did any legal work on any City of Asheville eminent domain seizures while Mayor Manheimer was in office and 5 years prior to 2009.

    Good morning Sunshine Request,
    Thank you for your request regarding the number of eminent domain seizures involving Esther Manheimer and the City of Asheville from 01/01/2004 – 04/16/2020. The city does not maintain a list or database of these, therefore we have no relevant records to your request. (Pursuant to G.S. 132-6.2(e) “Nothing in this section shall be construed to require a public agency to respond to a request for a copy of a public record by creating or compiling a record that does not exist.”)

     

    However, we believe the requester may have some success finding this information by looking through city council minutes and agendas. On our website you can find City Council meeting materials dating back to 2012 and City Council minutes dating back to 1984 here. Additional physical meeting information can be found in our archives and we’re happy to set up an appointment for the requester to come review those in person.

     

    Lastly, in regards to law firms, the City worked with Brown & Bunch during that time.
