Hello Asheville, NC City Schools (Mark, Ashley, and Dillon Cced),

I'd like to make a multi-part public records request for the following information under NC Public Records Law.

A) Please provide all texts and emails exchanged between Asheville City Schools Central Office staff and Asheville City Council / Council members, regarding Asheville Primary School and concerning public comment about the fate thereof. Please provide all responsive records during the specific time period of January 01, 2020 through December 31, 2021.

B) Please provide all texts and emails exchanged between Asheville City Schools Central Office staff and Asheville City Schools Foundation, regarding Asheville Primary School and concerning public comment about the fate thereof. Please provide all responsive records during the specific time period of January 01, 2020 through December 31, 2021.

    Good afternoon Asheville City Schools,

     

    I have followed up multiple times on my public records request sent to your offices on April 25. Having have received no response, I am now marking this request as “Denied” on our website:

     

    (April 2022) Multi-part request for Asheville City Schools: ACS Central Office staff, AVL City Council, and ACS Foundation texts and emails regarding Asheville Primary School. 01/01/2020 – 12/21/2021

     

    In the past, I’ve been told to send requests to “Executive Director of Communications, Ashley Thublin” and, ”Communications Specialist, Dillon Huffman”. I have attempted emailing multiple people, and have never received any reply clarifying who is currently in charge of fulfilling records requests and why they are not being fulfilled. I’ve also had to “Close / Deny” other ACS requests throughout the past year, for the same reasons – This is unacceptable.

     

    Please specify who is the appropriate contact at ACS to fulfill public records requests, and please provide an explanation why there has been no response to my request since April 25.

     

    ACS is required to process all valid public records requests under NC Public Records Law. If you are intentionally delaying fulfillment of the request by allowing it to “sit” until staff has availability or feels like addressing, then I worry you are not processing public records requests in compliance with the Law.

     

    With this in mind, I want to highlight the court case referenced in item #6 of the following article, posted on the NC Press Association website. In this instance: “The trial court held that an unjustified one-month delay in production of records was tantamount to a denial”.

    I respectfully ask that legal staff take immediate action to resolve this issue and ensure that ALL public records requests are being fulfilled by ACS as required under NC Public Records Law.

     

    I will continue to submit public records requests to ACS in the future, and I would like assurance that I will receive a response and that requests are being processed by your offices in accordance with the law.
