(April 2022) Request for Asheville City Schools: Total # of students with IEPs, Special Education and Exceptional Children (EC) positions and vacancies, IEP disciplinary referrals for 2019, 2020, and 2022.

Hello Asheville, NC City Schools (Mark, Ashley, and Dillon Cced),

I'd like to make a multi-part public records request for the following information under NC Public Records Law.

A) Please provide the total number of students who have IEPs at each ACS school, including Asheville Primary and the Preschool programs, as of 04/15/22 (or date the query is performed). Numbers or percentage of student population at each school would be fine.

B1) Please provide the total number of Special Education and Exceptional Children (EC) teachers at each ACS school, as of 04/15/22 (or date the query is performed).

B2) Please provide the total number of Special Education and Exceptional Children (EC) teacher position vacancies at each ACS school, as of 04/15/22 (or date the query is performed).

C1) Please provide the total number of disciplinary referrals for IEP students that have occured during the 2022 school year, broken down by each school. As of 04/15/22 (or date the query is performed).

C2) Please provide the total number of disciplinary referrals for IEP students that occurred during the 2019 - 2020 school year, broken down by each school.

NOTE: I am not requesting any personally identifiable information such as name, age, grade level etc. I’m only asking for overall totals or percentage of student population.

    Good afternoon Asheville City Schools,

     

    I have followed up multiple times on my public records request sent to your offices on April 18. Having have received no response (other than Sarah Bank’s reply asking to be removed from the CCs), I am now marking this request as “Denied” on our website:

    In the past, I’ve been told to send requests to “Executive Director of Communications, Ashley Thublin” and, ”Communications Specialist, Dillon Huffman”. I have attempted emailing multiple people, and have never received any reply clarifying who is currently in charge of fulfilling records requests and why they are not being fulfilled. I’ve also had to “Close / Deny” other ACS requests throughout the past year, for the same reasons – This is unacceptable.

     

    Please specify who is the appropriate contact at ACS to fulfill public records requests, and please provide an explanation why there has been no response to my request since April 18.

     

    ACS is required to process all valid public records requests under NC Public Records Law. If you are intentionally delaying fulfillment of the request by allowing it to “sit” until staff has availability or feels like addressing, then I worry you are not processing public records requests in compliance with the Law.

     

    With this in mind, I want to highlight the court case referenced in item #6 of the following article, posted on the NC Press Association website. In this instance: “The trial court held that an unjustified one-month delay in production of records was tantamount to a denial”.

    I respectfully ask that legal staff take immediate action to resolve this issue and ensure that ALL public records requests are being fulfilled by ACS as required under NC Public Records Law.

     

    I will continue to submit public records requests to ACS in the future, and I would like assurance that I will receive a response and that requests are being processed by your offices in accordance with the law.
