(February 2020) Request for City of Asheville, NC Grandfathered Short Term Rentals info
Hi City of Asheville, NC Government,
I would like to make a public records request for the following:
Please provide a list of any and all grandfathered Short Term Rentals, or STRs that have been allowed and approved which did not or do not meet the Homestay requirements (such as not having owner/applicant residing on property, etc).
Additionally, I would like to request the criteria under which those grandfather exceptions occurred and whether that was made available to all parties who received violation notices regarding STRs.
The above requests should include all responsive information from June 01, 2015 - January 26, 2020.

The City of Asheville does not have additional answers to the questions asked by the requester.
In January 2018, the city council adopted an ordinance that limited STVRs to property zoned as Resort. At that time, any permitted STVR, regardless of zoning district, was grandfathered and was allowed to continue operating. As long as the homeowner keeps the permit current, they will be able to operate their STVR in perpetuity. If they let their permit lapse then they will not be able to get a new permit and can no longer operate an STVR.
There has been no study to see if the grandfathered STVRs meet the Homestay requirements, as STVR requirements are completely different from Homestay requirements. If someone lets their STVR permit lapse, and if they live in a properly zoned area, and they meet all homestay requirements then they could apply for a Homestay permit, but not a STVR permit. I hope that makes sense.
There is no other information about STVR permits issued prior to 2018 or grandfathered on that date.

“Hi City of Asheville, NC Government,This is a follow up request related to a Completed request [(February 2020) Request for City of Asheville, NC Grandfathered Short Term Rentals info] found here. I’d like to ask that the request be “reopened” and updated, to now include the following (3 requests below). The previous request asked for:
“Please provide a list of any and all grandfathered Short Term Rentals, or STRs that have been allowed and approved which did not or do not meet the Homestay requirements (such as not having owner/applicant residing on property, etc).
Additionally, I would like to request the criteria under which those grandfather exceptions occurred and whether that was made available to all parties who received violation notices regarding STRs.

I feel that the questions have not been fully answered. Specifically,
“Please provide a list of any and all grandfathered Short Term Rentals, or STRs that have been allowed and approved which did not or do not meet the Homestay requirements (such as not having owner/applicant residing on property, etc).”
This question is referring to Grandfathered Short Term rentals that DID NOT MEET the homestay requirements, yet were permanently considered OK and grandfathered, while others were not allowed that same status, or even given the opportunity to be.
1. Please provide the “who” or “why” of such statuses being granted.
I also feel that the responsive documents, and response from Terry, did not answer the question, but seemed to refer to more recent grandfathering of properties that DID meet the Homestay requirements.
From Terry – “STVRs were grandfathered if they were operating with a permit in 2018. The records that I provided to you on February 14, 2020, are the only records responsive to your request.”
The request was for ones that DID NOT (such as not having the owner on site and living in part of the dwelling….no stoves, etc).
2. I’d like to request that you please provide a list of any and all grandfathered Short Term Rentals, or STRs that have been allowed and approved which did not or do not meet the Homestay requirements (such as not having owner/applicant residing on property, etc).
3. Additionally, I would like to request the criteria under which those grandfather exceptions occurred and whether that was made available to all parties who received violation notices regarding STRs.
I’d like to update the above requests to now include all responsive information from June 01, 2015 – March 27, 2020.”

I don’t believe that the request was fully answered / completed. Specifically:
“I would like to request the criteria under which those grandfathered Short Term Rental exceptions occurred and whether that was made available to all parties who received violation notices regarding STRs.”
To clarify, I’d also like to now request that you please provide emails or other correspondence with any criteria lists and what exceptions were made (such as not having to have an owner / host present on site, having more than 2BRs, having stove, etc).
Please also provide information about where this info. was posted online or how it was made equally available to all persons who received letters to terminate their STRs.
The information requested should include responsive records during the time period of June 01, 2015 to February 15, 2020.”
