(February 2021) Request for Asheville, NC Police Department – Deputy Chief salary / personnel info

Hello City of Asheville, NC Government (APD),

I'd like to make a public records request for the following information:

1) Please provide all "releasable items" from DC Baumstark’s personnel (or "personal") file. This should also include starting pay, and all pay raises since he began employment with the Asheville Police Department until the date the query is performed.

2) Please provide all emails regarding DC Baumstark's pay negotiations.

    Good morning Sunshine Request,
    Baumstark’s personnel file can be found here:. https://drive.google.com/file/d/16bZadJAOAzBNZz-hdMdBVmO9zV8FDqPZ/view?usp=sharing. This one was generated July 2020 but I verified with HR today that there are no new actions to report since then.

     

    As you know, only a defined portion of information within a personnel file is public record, as outlined by N.C. General Statute § 126-23. While an employee’s salary is public record, if negotiations were to take place regarding that salary it would remain confidential. Therefore, we would have no responsive records if we were to do the email search.
