Hello Morehead City, NC Government (Records Officer),

I'd like to make a public records request for the following information under NC Public Records Law

Hi Cathy and Susan,

Thank you for providing an update on the status of the request.

I’d like to address Susan’s email from March 03:

“ I am right in the middle of my busiest time of year and my priorities at this time are greater than the request. I apologize for the delay but at this time cannot give you a tentative date of turnaround. ”

This response indicates that City Staff may be intentionally delaying fulfillment of the request by allowing it to “sit” until staff has availability to address.

I do understand if staff is busy at the moment, but I want to express my concern regarding management of this public records request (which was sent in again on 01/28/22). If Staff have been directed to delay processing requests until they are available to fulfill them, then I worry that the City is not processing public records requests in compliance with NC Public Records law.

With this in mind, I want to highlight the court case referenced in item #6 of the following article, posted on the NC Press Association website. In this instance: “The trial court held that an unjustified one-month delay in production of records was tantamount to a denial”

I understand if the City has reduced capacity to process the request at the moment. However, despite these challenges, the City is still required to process all valid public records requests.

I respectfully ask that the City take immediate action to resolve this issue and ensure that ALL public records requests are being fulfilled as required under NC Public Records Law.

Please provide an estimated timeline for completion. I’ll plan to follow up again in a week if I have not heard back.
