Please reply promptly to the following public records request, which is being made in accordance with NC Public Records Law.

** I’m simply requesting an electronic copy of an electronic record, if one exists. I am NOT asking to come in person to inspect, nor to obtain a printed copy of, these electronic records. According to your website, Vaya Health currently operate(s) “… in the following North Carolina counties: Alamance, Alexander, Alleghany, Ashe, Avery, Buncombe, Caldwell, Caswell, Chatham, Cherokee, Clay, Franklin, Graham, Granville, Haywood, Henderson, Jackson, Macon, Madison, McDowell, Mitchell, Person, Polk, Rowan, Stokes, Swain, Transylvania, Vance, Watauga, Wilkes, and Yancey. Please provide a list of all current Vaya Health Employees and their salaries – specifically, I’m asking for ONLY the employees of the ‘Care Management Department’ – in all NC counties. As of 07/26/23 or present day (date the query is performed). Please include the following:
1) Employee first / last name
2) Original Hire Date
3) Current Position / Title / Department
4) Current Salary (including hourly wage, hourly rate, or salary -- whichever payment structure is applicable to the employee)
Ideally, I’d like to receive the responsive records in an Excel or machine-readable format, if possible.
If any / all of this info is already publicly available online, please provide a link to where it can be accessed.

I reviewed the attached document by Amy Mody. I appreciate the acknowledgement that you’re still working to “produce records responsive to [my] request in due course.” However, I’d like to clarify a few points related to the statutes you cited: § 132-6(c) , § 132-6.2.(b) , and § 132-6.2.(e). https://www.ncleg.net/enactedlegislation/statutes/html/bychapter/chapter_132.html
1) Amy states that if my request “… requires ‘extensive use of information technology resources or extensive clerical or supervisory assistance’ such as redaction of confidential information, [you] may impose a reasonable service charge in addition to the actual cost of duplication which [you] have a right to charge pursuant to N.C.G.S. § 132-6.2(b) and guidance from the N.C. Department of Cultural Resources.”
Under NCGS § 132-6 you cannot charge for the labor involved in reviewing records to determine what records or parts of records may be provided. I specifically understand that under § 132-6(c), “If it is necessary to separate confidential from nonconfidential information in order to permit the inspection, examination, or copying of the public records, the public agency shall bear the cost of such separation.” You cannot charge for the staff time, labor involved, or other legal fees required to review, redact, or separate confidential from non-confidential information in public records. That cost burden is yours to bear. Therefore, there should not be any associated fees for my request, in that regard.
2) I understand there is a section of NC Public Records Law which allows you to charge “reasonable” fees under certain circumstances. However, I do not expect there to be any fees required for the production of this very simple record [salaries]. Over the years I’ve submitted 100+ requests for salary data to entities across North Carolina. The type of basic salary data I’ve requested from you (Name, Title, Salary, Hire Date) is simple to provide, is very commonly produced, and is widely considered a matter of public record as part of the public personnel file of employees. Many entities around the state fulfill requests like this via email within 1 week, and in many cases 1 day.
I don’t know what salary infrastructure Vaya Health’s Care Management Department uses, but it likely provides staff with a mechanism to query and download the responsive records with a high level of efficiency. It seems reasonable to assume that you should be able to fulfill most requests that require only a simple query, without triggering a special service charge.
I’d like to state again [as I did when submitting the request] that by submitting the request I have not agreed / am not agreeing to pay any potential fees related to my request. If you determine it isn’t possible to process the request without incurring fees for some reason, then please provide me with a clear description of the exact fees and totals you feel are required for this specific salary request, as well as where they are justified under the Law. And please do not proceed until I can respond. I will consider my next steps from there.
3) Amy states that “… [I] should know that nothing in the Public Records Act ‘shall be construed to require a public agency to respond to a request for a copy of a public record by creating or compiling a record that does not exist,’ as outlined in N.C.G.S. § 132-6.2(e).”
I have not asked you to create a record that does not exist. And, per the rest of § 132-6.2(e) — I have not asked you to “put into electronic medium a record that is not kept in electronic medium.” I’m confident that these records (Name, Title, Salary, Hire Date) are already kept in an electronic medium, and that you have access to that data.
I’d like to state again [as I did when submitting the request] that “I’m simply requesting an electronic copy of an electronic record, if one exists. I am NOT asking to come in person to inspect, nor to obtain a printed copy of, these electronic records. I’m requesting explicitly that any responsive info be provided to me via an electronic medium / format (in which the copy of these records should already exist).”
I’ll follow up with you again mid-September, if I haven’t heard anything else before then.
