Please reply promptly to the following public records request, which I’m making in accordance with NC Public Records Law. https://www.ncleg.net/enactedlegislation/statutes/html/bychapter/chapter_132.html

Please provide the electronic copy of all “public surety bond claims made” and all “public surety bond claims paid” (Westfield Insurance Company) from November 22, 2023 to the present day [on the date the query is performed]. Specifically – as relates Gaston County, NC Office of the Sheriff Chad Everette Hawkins BND2793720.

** I’m simply requesting an electronic copy of an electronic record, if one exists. I’m NOT asking for the opportunity to come in person to “inspect”, nor to obtain a printed copy of, this electronic record. I’m requesting explicitly that any responsive info be provided to me via the electronic medium / electronic format (in which the copy of this record already exists). If you are unable to fulfill any or all parts of this request, please specifically cite where a reason for denial is justified under NC Public Records Law. **

    Upon further review, we realized that at the time we submitted the request to your office we misunderstood / weren’t aware that these “surety bond claims” would include info about a single arrest or complaint. We have a policy that indicates we will not fulfill the following type of request:

    It seems to me that the content of some of the emails / documents you shared above (although they are public records) are not entirely necessary to disclose in order to provide me with the records responsive to my request. I don’t think that I can post some of those communications on my website. Because we share the results of all requests publicly on our site, we have policies about certain types of requests and data that we will not process.

     

    I will need some time to discuss this email with my team, and I will get back to you next week. Once I’ve determined if the request is completed, or any next steps, I’ll let you know.

    I understand you’re saying a claim was made, but it was Denied by Westfield and you do not have access to that file. However, I just want to clarify — are you also saying that on your end the County has no public record of any claims being submitted that you can provide to me? I assume that if a County email / account was used to submit a claim, you would be able to provide a copy of that record.
