Mr. Conant: The City is working to respond to the above referenced request. Some of the 6 parts do not ask for documents that the City can produce, and the cost of making calculations and producing that information would be significant. I have asked the City to present existing documents and I will be in touch, once I have had an opportunity to review them.

Editor’s Note 04/07/20: City of Brevard Government is experiencing delays in their processing of records requests due to the outbreak of COVID-19. We received this information in an email from City Attorney, Michael Pratt on 4/06/20 related to follow up we sent on this request – the contents of that email are pasted below:

“The city clerk has informed me that, due to the virus, there is no one working in the office at the present time to follow up with regard to this request. She will let me know when someone will be available to do so.”

Keeping this update in mind, Sunshine Request will be putting all City of Brevard, NC related request follow ups on hold for a couple weeks. We will plan to check back in with them again later in April. Additionally, if we receive any new requests for Brevard, NC Gov., we will continue to send them in as usual, but will note that it could be some time before we receive a reply.

Thank you for using Sunshine Request!

    Good Afternoon Michael,

    Thank you for your reply!

Our apologies – we’re confused by your statement RE: attachments.

We didn’t send any attachments with our request email. However, within our initial email, we did happen to include a link to our website (www.sunshinerequest.com). We’ve always done this just so we can provide a link to any government entities that may be wondering what Sunshine Request is. It’s not necessary for you to click the link though.

To be clear, all of the request details (Subject: (March 2020) Request for total cost of City of Brevard, NC depot) are contained in our original email, and there should not be any attachments included.

Please let us know if you have any trouble viewing the email, and we’ll be happy to resubmit the request.

    Thank you!

Dear Sunshine Request: Our cyber insurance recommends that we not open attachments in emails unless we both know the sender and are expecting the attachment. I recommend that the city follow the same rule, for cyber safety. Therefore, please submit the actual request to us as opposed to just a link to your website. Thank you.

Good afternoon City of Brevard, NC,

We hope you’ve been well and are staying safe during this unusual time in which we find ourselves.

We’ve received a new public records request via our website www.sunshinerequest.com for info that may be available in your office. Please confirm receipt to let us know that the request will begin processing, and if possible, please provide a rough estimate of when the request may be completed. We will plan on following up again around that time.

We’ve learned through our previous correspondences with Michael and Jill related to other requests that, “the City does not respond to anonymous FOIA requests. When you submit a FOIA request on behalf of a third party, we require the requesting individual party’s name, address and proof that he or she has executed the request and designated your organization to make the request on his or her behalf. If there is a cost for the copies, we will let you know that before responding to the request, and your organization or the requesting party must agree to pay that cost.”

Please note that we are not making a FOIA request. We are making a public records request under NC Public records law NCGS 132, under which there is no provision requiring an individual to provide a name or address with a public records request. That being said, if it will help speed along the request we are happy to provide a name and address –– you can consider that this request is made by Patrick Conant, who is the director of Sunshine Request. His address is PO Box 17391, Asheville NC, 28816.

We’d also like to ask that the requested information be delivered in a digital or machine readable format if possible. Please note that we cannot commit to covering any fees / associated costs related to any requests on our site. If there is a possibility that any cost may need to be incurred in order to process the request, please let us know and we will note this for the requestor, should they decide to pursue the request directly with your office.

Here are the details of the request:

Subject: (March 2020) Request for total cost of City of Brevard, NC depot

Message: “Hello City of Brevard, NC,

I’d like to make a public records request (under NC Public records law NCGS 132) for the following information:

Please provide the total cost of the building, parking lot, bike path, and bike path bridge built on Railroad Avenue. Please include the price paid for land, cost of plans, total cost of construction of building.

I’d also like to ask that you please provide the information broken down into a list of each process:

    2. Plans

    3. Total cost of construction of building

    4. Parking lot

    5. Bridge

    6. Bike path cost

    7. Any other expense related to project

    8. Total

    Thank you for your assistance!”

** Sunshine Request makes no claim as to the veracity of any statements or information contained in any of the requests, or public records, we receive.

    Thank you for your help!
