I am unclear as to if you are requesting additional records for this request? The provided documents are the responsive to the request and all information included in them is public record. You are absolutely able to create a redacted version of the provided public records or create a new document based on these records to put on your website but as outlined in N.C. General Statute § 132-6.2 (e), we are not required to create a record that does not exist. I’m sorry it’s taken so long to review the files and follow up with you RE: “(March 2020) Request related to “Seized Property” in City of Asheville and Buncombe County, NC for the last 5 years”.
We really appreciate all the time it has likely taken you (and other records officers) to process the request!
The original request asked for Seized Property in the City of Asheville:
“…. during the time period of 03/01/2015 – 03/11/2020:
1. Please provide all internal policies for [APD] concerning seizing property of a person or business under civil forfeiture.
2. A list / dollar amounts of property / assets that were seized under these forfeiture policies and converted to the use of the [Police] for the past 5 years.
3. Please include all reports related to these seizures as well as associated information from the courts wherein the assets were forfeited.”
I’ve reviewed the files you sent over in December (not published on our site), and need to ask for some amendments to be made. It has been over a year since the request was first sent in, and we sincerely apologize for not catching this edit sooner:
We realized the files related to items #2 and #3 go against our policies about the types of info we will post on our site. Specifically, Sunshine Request will not fulfill: “Requests for public safety information specific to a single individual, address, incident or name. This includes police reports, calls for service, complaints / incident reports / citations, criminal / arrest type records, or camera footage. We will, on a case by case basis, fulfill public safety related requests that focus on system-level trends and data…”
With this in mind, we’d like to ask if it is possible for you to restart the process to fulfill an amended version of the original request? We’d ask that it should now read as follows, to exclude personally identifiable information such as name, address, case number, etc:
“Hello City of Asheville (and APD),
I’d like to make a public records request for the following information. The responsive records should include information during the time period of 03/01/2015 – 03/11/2020:
1. Please provide all internal policies for [APD] concerning seizing property of a person or business under civil forfeiture.
2. Please provide a list of dollar amounts, and dates of property / assets that were seized under these forfeiture policies and converted to the use of the [Police].
