(March 2021) Request for Asheville, NC City Schools Superintendent internet search history/websites and sent emails 08/01/20-03/01/21

Hello Asheville, NC City Schools (Public Records Officer and/or IT Department),

I'd like to make a multi-part public records request for the following information as relates to Superintendent Dr. Gene Freeman:

1. Please provide Mr. Freeman's internet Search History from August 01, 2020 to March 01, 2021.
- System Restore / DNS Cache sufficient.

2. Please provide Mr. Freeman's internet Websites visited from August 2020 to March 01, 2021.
- Again, via System Restore / DNS Cache.

3. Please provide all of Mr. Freeman's "Sent" emails from August 01, 2020 to March 01, 2021

    Following up a 4th time on this. Please let me know if there is a more appropriate email contact to handle public record requests that relate to ACS.

     

    I am aware of what you’ve cited about creating records that don’t exist:

     

    “(e) Nothing in this section shall be construed to require a public agency to respond to a request for a copy of a public record by creating or compiling a record that does not exist. If a public agency, as a service to the requester, voluntarily elects to create or compile a record, it may negotiate a reasonable charge for the service with the requester. Nothing in this section shall be construed to require a public agency to put into electronic medium a record that is not kept in electronic medium. (1995, c. 388, s. 3; 2004-129, s. 38.)” https://www.ncleg.net/enactedlegislation/statutes/html/bysection/chapter_132/gs_132-6.2.html

     

    However, for things like all “sent emails” from a specific employee as requested in Item #3 above, this does already exist in an electronic medium by nature of being an email. Are you saying that this record cannot be produced? And if not, can you please cite that exemption under NC Public Records law and a reason for the denial?

    Upon reviewing the request and your reply, I need some clarification on which items from this request cannot be completed? The request asks for the following:

    The public records law G.S. § 132-6.2(e) provides that a public agency need not “respond to a request for a copy of a public record by creating or compiling a record that does not exist.” Such a request would require the creation of new records that do not otherwise exist.

    We are aware from previous correspondence that you’ve asked us not to CC Dillon on any emails, but since we haven’t heard from you on any of our submitted requests for some time now, we are trying to determine who is the appropriate contact for public record requests.
