Hello Asheville, NC City Schools (Records Officer),

I'd like to make a multi-part public records request for the following information under NC Public Records Law.
Ref: https://www.ncleg.net/enactedlegislation/statutes/html/bychapter/chapter_132.html

A. Please provide copies of all of Melissa Hedt’s employment contract(s) with Asheville City Schools -- as relates to the specific time period of 12/01/10 through the date the query is performed.

B. Please provide Melissa Hedt’s employment history with Asheville City Schools. Specifically, please provide a list of all position titles, and dates of all positions, she has held in the school system from 12/01/10 through the date the query is performed.

** If you are unable to fulfill any or all parts of this request, please specifically cite where a reason for denial is justified under NC Public Records Law. **

Thank you for your assistance!

    Good afternoon Asheville City Schools,

I have followed up multiple times on my public records request sent to your offices on March 16. Having have received no response (other than Georgia Harvey’s reply asking to be removed from the CCs), I am now marking this request as “Denied” on our website:

    https://www.sunshinerequest.com/records_request/march-2022-request-for-asheville-nc-city-schools-deputy-superintendent-of-accountability-and-instruction-employment-history-and-contracts-12-01-10-present/

In the past, I’ve been told to send requests to “Executive Director of Communications, Ashley Thublin” and, ”Communications Specialist, Dillon Huffman”. I have attempted emailing multiple people, and have never received any reply clarifying who is currently in charge of fulfilling records requests and why they are not being fulfilled. I’ve also had to “Close / Deny” other ACS requests throughout the past year, for the same reasons – This is unacceptable.

Please specify who is the appropriate contact at ACS to fulfill public records requests, and please provide an explanation why there has been no response to my request since March 16.

ACS is required to process all valid public records requests under NC Public Records Law. If you are intentionally delaying fulfillment of the request by allowing it to “sit” until staff has availability or feels like addressing, then I worry you are not processing public records requests in compliance with the Law.

With this in mind, I want to highlight the court case referenced in item #6 of the following article, posted on the NC Press Association website. In this instance: “The trial court held that an unjustified one-month delay in production of records was tantamount to a denial”.

    http://www.ncpress.com/stories/a-bakers-dozen-for-2022nc-public-records-law,2390

I respectfully ask that legal staff take immediate action to resolve this issue and ensure that ALL public records requests are being fulfilled by ACS as required under NC Public Records Law.

I will continue to submit public records requests to ACS in the future, and I would like assurance that I will receive a response and that requests are being processed by your offices in accordance with the law.

    Thank you!

Good afternoon Mark (Ashley and Dillon CC’d),

This is our 4th follow up with no reply. I will make one more attempt at following up around the end of the month before marking this request as denied.

This email is in regard to a records request we sent in to ACS on 03/16: (March 2022) Request for Asheville, NC City Schools: “Deputy Superintendent of Accountability and Instruction” employment history and contracts 12/01/10 – present

We understand you are likely very busy, however we have been following up with Ashley, Dillion, and others at ACS, with no reply, and have just been told by Georgia Harvey that “all requests go through our communications department”. We have seen that Mark has replied to a separate request of ours recently. Thank you! Mark – Can you, Ashley, or Dillon, please clarify to whom and what email address the request above, and all future ACS public records requests should be sent? Since we are continuing to receive new requests we need to send to ACS, we’d like to determine who is the best contact to ensure that we receive a reply to all records requests. Additionally – Please confirm receipt of the request above, and let me know when you anticipate completion.

    We appreciate your help!

    Good afternoon Asheville City Schools,

I’m following up on this public records request that was sent in on 3/16: (March 2022) Request for Asheville, NC City Schools: “Deputy Superintendent of Accountability and Instruction” employment history and contracts 12/01/10 – present

In the past, we’ve sent these requests to Ashley Thublin, but as of late we’ve never heard back from her on our latest requests after multiple follow ups with Dillon Huffman CC’d. We’ve had to mark these requests as denied, but we’d really appreciate it if you could provide the appropriate email to send these requests to if Ashley is not the appropriate contact.

Please confirm that the request has been received on your end, and if / when it will begin being processed. Please provide a timeline or rough estimate as to when the request will be completed, and I will follow up around the time you specify.

In any case, I’ll plan to follow up again in mid-April if I have not heard back before then.

    Thank you for your assistance!
