City of Asheville Submitted: March 10, 2022 | Updated: August 5, 2022

(March 2022) Request for City of Asheville, NC Government: City Staff, Council, and public communication and materials related to 3/10/22 East End/Valley Street community meeting. 01/01/22 – present day.

Hello City of Asheville, NC Government (Records Officer),

I'd like to make a public records request for the following information under NC Public Records Law.
Ref: https://www.ncleg.net/enactedlegislation/statutes/html/bychapter/chapter_132.html

On Tuesday, March 08, 2022 at 8:28am the City Clerk sent out a notice describing a “City Council Invitation”:

“ City Council has been invited to attend the virtual East End/Valley Street community meeting on Thursday, March 10, 2022, at 6:00 p.m. City staff will be present to present options for the track at Memorial Stadium. Council is attending only to receive information, and no Council votes or other action will be taken. ”

Please provide all emails, texts, social media messages, and any other communications records Sent to, Sent from, and Sent between any and all members of Council, and City Staff during the time period of January 01, 2022 to Present day (date the query is performed).

This request should also include the same communications records Sent to, Sent from, and Sent between any members of the public and Staff or Council during the same time period -- provided that at least one recipient is a member of City Council or City Staff.

Specifically, I’m requesting communications that relate to the following topics:

- the East End / Valley Street community meeting on March 10th.
- the track at Memorial Stadium.
- invitations from the East End / Valley Street neighborhood to Council or Staff.
- discussions amongst Council members or between Council members to Staff about attendance.
- discussions regarding whether City-produced meeting materials should be made public.
- discussions regarding whether the meeting should be live-streamed or recorded.
- discussions regarding whether public notice was required.
- discussions regarding whether this event represents a public meeting.

*** Please provide the files in a .PDF format so that they can easily be opened / viewed.

Please provide any .pdfs, other files, attachments, videos, hyperlinks, etc. that are indicated or referenced within the responsive records. For example: A .pdf that is an attachment within an email, should also be provided as a file along with the responsive emails. Or, a link should be provided so that the file can be opened.

If the records are ultimately too large to send via emailed file share, I'd ask that you please create a public Google Drive folder / link or some other file format to transfer the files electronically.

I understand that due to the volume of this request, it could take some time to process. If possible, please provide an estimated timeline for completion. If you are unable to fulfill any or all parts of this request, please specifically cite where a reason for denial is justified under NC public records law. ***

I’m following up on the request above [(March 2022) Request for City of Asheville, NC Government: City Staff, Council, and public communication and materials related to 3/10/22 East End/Valley Street community meeting. 01/01/22 – present day.].

The request has not moved from position #4 in the City’s “Email Search Queue” in the past 20 days (since July 06). Can you please clarify any reason for the delay, as well as the newly anticipated date of completion for the request (first sent to the City on March 16, 2022)?
